AMENDMENT NO. #I TO <br />City of Eugene Contract No. 1997- 00410 <br />This Amendment is made to the Lease Agreement dated June 10, 1997, between the City of Eugene (City) <br />and Land Transit District (Contractor). <br />City and Contractor mutually agree to the following and amend the contract referenced above as follows: <br />According to the records of the City, LTD was billed for and paid for annual lease and landscape <br />maintenance services for calendar years 1997, 2003, 2004, 2005 and 2006. In error the City did <br />not bill Contractor for lease payments or landscape maintenance reimbursement fees for 1998, <br />W �,2OOland 20(01. This was discussed with LTD Purchasing Supervisor who agreed the parties <br />would discuss the payment of the 2001 and 2002 lease and landscape maintenance reimburse- <br />ment, allowing Contractor time to obtain the necessary funding to cover the payments. <br />In an effort to resolve this issue, the City and Contractor agree that LTD shall make the following <br />payments: <br />2000 Annual Lease Payment <br />$1,900.80 <br />2000 Landscape Maintenance fee <br />$1,320.50 <br />2001 Annual Lease Payment <br />$1,900.00 <br />2001 Landscape Maintenance fee <br />$1,320.50 <br />Total of past due payments <br />$6,442.60 <br />. ' <br />The City will forgive the payments due for 1998 and , an amount which totals 0 - 44M_. <br />For 2007, the rates in Exhibit B are amended to reflect the following changes: <br />a. Land Rental <br />Current value of large raw land parcels in the area: $xxx <br />Value of site (.396 acre) $xxx <br />Annual rent at 8% per year $xxx <br />Landscape Maintenance Reimbursement <br />Current cost to maintain landscaping for one (1) year $xxx / sq ft <br />Area to be maintained 6950 sq ft <br />Maintenance costs for 1 year. $xxx <br />Upon receipt of the fully executed agreement, LTD shall make payment of the 2000, 2001 and <br />2007 calendar years for both annual lease payment and landscaping maintenance reimbursement <br />fees. <br />All other terms and conditions of this contract remain in full force and effect. <br />CITY OF EUGENE <br />Dennis M.
