• <br />AMENDMENT NO. #1 TO <br />City of Eugene Contract No. 1997 -00410 <br />This Amendment is made to the Lease Agreement dated June 10, 1997, between the City of Eugene <br />(City) and Land Transit District (Contractor). <br />City and Contractor mutually agree to the following and amend the contract referenced above as follows: <br />According to the records of the City, LTD was billed for and paid for annual lease and landscape <br />maintenance services for calendar years 1997, 1999, 2000, 2003, 2004, 2005, 2006 and 2007. In error the <br />City did not bill LTD for lease payments or landscape maintenance reimbursement fees for 1998, 2001, <br />2002, 2008 & 2009. <br />In an effort to resolve this issue, the City and LTD agree that LTD shall make the following payments: <br />2001 Annual Lease Payment $1,900.8000 <br />2001 Landscape Maintenance fee $1,320.50 <br />2002 Landscape Maintenance fee $1,320.50 <br />2002 Annual Lease Payment $1,900.8009 <br />2008 Landscape Maintenance fee $1,320.50 <br />*2008 Annual Lease Payment fee (See °b" below) $ 752;00 `Comment [HNi] This is sa <br />�� <br />i ai o0 <br />2009 Landscape Maintenanc6 ee $1,320.50 <br />- <br />*2009 Annual Lease Payment fee (See - b - below) $4,752.00 <br />Total past due payments for these items: $18,587.60 <br />In consideration of length of time, the City will forgive the payments due for 1998, an amount which total <br />$3,221.30. <br />For 2008 & 2009, Exhibit B has been amended to reflect the following changes: <br />a. Land Rental <br />Current value of large raw land parcels in the area: $150,000 <br />Value of site (.396 acre) $ 59,400 <br />Annual rent at 8% per year $ 4,752 <br />b. Land value increases /decreases for the yearly contract payment will be based on a current <br />market assessment performed by the City of Eugene's Sr. Real Property Officer. <br />c. All landscape and facility maintenance (mowing, weeding, pruning, fertilization, replacement <br />planting & trash control etc.) for the 6950 SQFT site will become the responsibility of LTD - <br />as of January 1, 2010. <br />Upon receipt of the fully executed agreement, LTD shall make payment of the 2001, 2002, 2008 and 2009 <br />calendar years for both annual lease payment and landscaping maintenance reimbursement fees. <br />Tetaling $18,556 <br />All other terms and conditions of this contract remain in full force and effect. <br />CITY OF EUGENE <br />Kurt Cory P,_E. <br />Public Works Director <br />CONTRACTOR <br />Mark Pangborn <br />General Manager <br />Date: Date: <br />
