L l G- LA 4 1 � <br />EASEMENT AGREEMENT <br />This is an Agreement dated this 16th day of October. 1992, <br />among the City of Eugene (City), Bill and Molly Norris, and the City of Eugene, <br />Parks Department ( Parks Dept.) . <br />RECITALS: <br />A. City is a municipal corporation, duly organized and existing under the <br />laws of Oregon. <br />B. Norris's are the owners of a structure upon certain real property also <br />owned by Norris's and located at 344 Sunset Drive, within the corporate <br />limits of the City. The legal description of the real property ( Norris's) <br />is: <br />Map and Tax Lot #: 18 03 04 21 00900 <br />Lots 33 and 34 <br />Block 30 <br />Subdivision: Sunset Terrace <br />C. City of Eugene, Parks Dept. are. the owners of certain real property <br />located adjacent and due east of the eastern property line of the Norris <br />property, also within the corporate limits of the city. The legal de- <br />scription of the real property is: <br />D. The Norris single - family residence (existing) is located 3 feet west from <br />the property line which delineates the Norris property from the property <br />of the City of Eugene, Parks Dept. Section 9.542 of the Eugene Code, <br />1971, provides that all structures within residential zoning districts <br />(within which Norris's property is located), shall have interior yards <br />of not less than five feet. <br />E. The City of Eugene, Parks Dept. has agreed to provide Norris's with <br />an easement, two feet In width by 59 feet in length, immediately adja- <br />cent to the property line.. <br />F. City is willing to consent to the creation of the easement, and to permit <br />the intrusion of the Norris addition into the interior yard setback, under <br />the terms and conditions of this Agreement. <br />
