Master Certification Agreement No. 24651 <br />City of Eugene Contract #2007-00202 <br />AMENDMENT NUMBER 01 <br />Oregon Department of Transportation <br />LOCAL AGENCY CERTIFICATION PROGRAM <br />Supplemental Project Agreement No. 24796 <br />West Bank Trail Extension: River Avenue to Beaver Street <br />City of Eugene <br />The STATE OF OREGON, acting by and through its Department of Transportation, <br />hereinafter referred to as "State;" and the CITY OF EUGENE, acting by and through its <br />designated officials, hereinafter referred to as "Agency," entered into an Agreement on <br />July 15, 2008. Said Agreement covers the construction of a new section of the West <br />Bank Trail shared-use path from River Avenue to Beaver Street; and a connecting path <br />south from the Beltline Road over-crossing. <br />It has now been determined by State and Agency that the Agreement referenced above <br />shall be amended to increase funding and update language. Except as expressly <br />amended below, all other terms and conditions of the Agreement are still in full force and <br />effect. <br />TERMS OF AGREEMENT, Paragraph 2, Page 1, which reads: <br />2. The Project shall be conducted as a part of the Transportation Enhancement Program <br />under Title 23, United States Code, which incorporated SAFETEA-LU. The total <br />Project cost is estimated at $1,181,300, which is subject to change. The <br />Enhancement =Funds for this Project are estimated at $1,060,000 with Agency <br />providing the match and any non-participating costs, including all costs in excess of <br />the available federal funds. The funds shall be used for the design and construction of <br />the Project. <br />Shall be deleted in its entirety and replaced with the following: <br />2. The total estimated cost of the Project is $2,075,000, which is subject to change. A <br />portion of the Project shall be conducted as a part of the Transportation Enhancement <br />Program (Enhancement) under Title 23, United States Code, which incorporated <br />SAFETEA-LU; and a portion of the Project shall be conducted as a part of the <br />Federal Aid Surface Transportation Program (STP) under Title 23, United States <br />Code. STP funds for this Project shall be limited to $800,000 and financed at the <br />maximum allowable federal participating amount. The Enhancement funds for this <br />Project are estimated at $1,060,000. Agency shall provide the match and any non- <br />participating costs, including all costs in excess of the available federal funds. The <br />Enhancement 'funds shall be used for the design, right of way, and construction of the <br />Project. <br />a. Agency must obtain approval from State's Transportation Enhancement Program <br />Manager for any additional funds beyond the amount in Paragraph No. 2 above. <br />Key No. 14763 <br />
