Those fields were
acceptable for use at the other sites. Since the SBMS field would accommodate a 113
yard soccer field, a 'reasonable' resolution to the shorter field issue would
have been to purchase movable soccer goals (instead of the desired permanent
football/soccer goals) and restripe the end lines of the fields. The moveable goals
and the cost of the additional turf would amount to $4,000 + $2,000 = $6,000.
The three parties agreed that the cost of the 'reasonable fix' would be borne by
PiVOT. The ageement was, then, that PiVOT would pay the first $6,000 of the cost
to extend the field, then COE, 4J and PiVOT would equally share in the balance of
the cost to extend the field by 10 feet to achieve a 'premium fix' that results in total
length of 380'.
