Eugene School District 41 <br />Facilities Management <br />Capital Improvement Program <br />715 West Fourth Avenue <br />Eugene, OR 97402 -5024 <br />August 16, 2010 <br />Mr. Dave Battaglia <br />City of Eugene Recreation Division <br />2700 Hilyard <br />Eugene, OR 97405 <br />RE: final Billing For Cal Young and Madison Fields <br />P-p-e- <br />Dear Ur.Battaglia= <br />Enclosed is the final billing for the Cal Young and Madison Middle School synthetic field projects. i have <br />attached documentation of the costs invoiced, In the amount of $41,000. <br />Since the last invoice requesting $666,405 for Cal Young and Madison MS fields, two things have <br />happened. First, Sprinturf finally provided an acceptable insured warranty and closeout documentation. <br />Based on our receipt of those Items, we released payment for the $23,000 we were withholding until <br />they did that. 507 : -t� I I ,`So( . <br />Second, we have had Sprinturf provide and install two truckloads of rubber infill at Cal Young and <br />Madison fields. As you may recall, Sprinturf did not finish on schedule and incurred $118,000 in <br />liquidated damages. In a negotiated settlement, we agreed to release half of that amount, $59,000, to <br />pay their subcontractor, Delta Sand and Gravel. Delta had preformed their work on schedule, but <br />Sprinturf had been refusing to pay them. <br />We were retaining the remaining $59,000 until Sprinturf performed 800 hours of repairs to the four high <br />school fields, over the course of 10 years. 41 was to release the $59,000 at the end of ten years, if <br />Sprinturf met the requirements of the agreement. Prior to this year, Sprinturf provided a total of 300 <br />hours of repair work. They were Interested in a way to get their money sooner than ten years, and <br />asked if there was something different that they could do. <br />We suggested that they could Install rubber infill, at their expense, at the Cal Young and Madison MS <br />fields, in lieu of continuing to repair the high schools fields. The reason that we offered this proposal <br />was that we have replaced two of the high school fields this year, and we will likely replace the other <br />two next year. That would leave no high school fields for Sprinturf to repair, and therefore we would <br />have not received any value for the remaining 500 hours they still owed for field:repair. <br />
