26.10 Confidentiality. <br />Tenant agrees and understands that Tenant has received special terms and <br />conditions in this Lease, which may not have been made available to other Tenants <br />in the Building. Tenant understands that knowledge by other existing tenants in the <br />Building of such special terms and conditions could cause damage to Landlord. <br />Accordingly, Tenant agrees to keep all terms and conditions of this Lease strictly <br />confidential and not directly or indirectly divulge such information to any third party <br />without Landlord's prior written consent. Not withstanding the above, Landlord <br />hereby consents to Tenant divulging the terms and conditions of this Lease to any <br />lender of financial advisor of Tenant in their capacity as lender or financial advisor. <br />26.11 Portion of Rent. <br />In the event of commencement or termination of this Lease at a time other than the <br />beginning or end of one of the specified rental periods, then the Monthly Base Rent <br />shall be prorated as of the date of commencement or termination and in the event <br />of termination for reasons other than default, all prepaid rent shall be refunded to <br />Tenant or paid on its account. <br />26.12 Smokin . <br />The Building has been designated as a "Non-Smoking Building."
