The developer was assessed <br />$26,172.90 ~documentativn attached « t=ile: SF05-06 Advance Payment.pdf», an advance payment assessment for <br />. future improvements to Dld Coburg Road which was classified as a ma~orcollectorstreet: Dld Coburg Road <br />improvements have been completed and yet, the improved alignment was shifted and the area where the advance payment was made, does not benefit from the improvements. <br />That said, the developer does have other portions of the Hawthorne Estates PUD that do benefit from the <br />improvements and are being assessed for the improvements. Instead of making an advance payment for these lots, he <br />submitted an irrevocable petition and agreed to paywhenthe improvements were.completed. The developer would <br />prefer~to have the paid assessments transferred to the now owing lots.. <br />As best I can see, EC7.240 LOCAL IMPROVEMENTS-REBATES is the closest code on refunding advance payments or over- <br />payments. This requires council input, but I thinkthat could be done with the assessment hearing.
