EUGENE WATER & ELECTRIC BOARD <br />ELECTRIC UNDERGROUND EXTENSION AGREEMENT <br />Date of Application: June 10, 2010 <br />City Of Eugene, hereinafter called the customer, requests the Eugene Water & Electric Board, hereinafter called EW EB, to extend its electric system to <br />serve: <br />Project Name & Location: Secondary Pole Dip- Pole 13928 b ' <br />River R0. North of Hamilton DR (for Pedestrian Signals) 10 Customer agrees the electric distribution extension will be provided In accordance. with the requirements and obligations of <br />this Agreementand <br />the attached Exhibits. Uglify service Is also subject to EWEB's applicable policies, regulations and rates now in existence or hereafter adopted, and the <br />attached drawing #8-26888. Customer has received and read copies of EW ES's existing written policies and standards. <br />Customer will execute all easements required by EWES at no oostto EWES. When practical, the customer will include such easements in the <br />recorded plat of the above-mentioned development. Customer will further record dead restrictions requiring underground service to all properties to be <br />served by the underground distribution system being installed. Customer agrees that all easements shall provide that no buildings or structures maybe <br />constructed on such easements. <br />Customer is aware of the right: as provided in ORS 92.097, to employ a licensed engineer to design or supervise the installation of the <br />Improvements provided for In this Agreement, but declines to do so. <br />Unless otherwise specified In this Agreement, the customer agrees to pay forthe following extension charges prior to EW EB's commencement of <br />work: <br />Contribution In aid of construction = $2050.00 <br />Other = <br />All charges above are subject to change If this Agreement is not signed and returned within thirty (30) days of the applicallon date above and if <br />the extension facilities are not Installed with permanent service connections within six (6) months of the date of application. <br />This Agreement authorizes EWES to proceed with the necessary steps to provide electrical underground services as shown on the attached <br />drawing; however, It Is understood that until the conditions of this Agreement are complied with. EWES will not install the extension facilities. <br />Customer agrees to Inform all subsequent owners of the requirements and obligations of underground service in accordance with the Board's <br />policies and procedures. This Agreement shall bird and benefit the heirs, personal representatives, successors or assigns of the respective parties. <br />® EWEB-CONSTRUCTED SUBSTRUCTURES: <br />Customer will be responsible for providing, within six Inches (6') of final grade, compacted level ground of adequatewidth for <br />EWES to install the uUlftysystems. Customer will provide finished grade stakes and property comers so EWEB can Install the utility <br />system at proper depth and location. Customer will monitor EWEB's Installation to assureffie Installation is acoordingto stakes that <br />have been provided. <br />❑ CUSTOMER-INSTALLED SUBSTRUCTURES: <br />Customer will own and maintain all customer-installed ducts and vaults, including service ducts In accordance with EWEB's <br />service policies. EWEB will own and maintain all other underground system facilities. H Is understood that the customer will <br />construct and furnish service lateral, Including duct, trench and backfill In accordance with EWER policy. <br />Customer assumes all liability and agrees to Indemnify EWES for all damages to EWES facilities caused by the customer or <br />customer's agents. <br />EWES shall assume ownership and responsibility for maintenance and repair of the service lateral conductors and conduit at <br />time of electrical connection. (See Board Policy, Electric Service Section IID(6).) <br />❑ DEVELOPER-INSTALLED SUBSTRUCTURES: <br />EWES shall allow Developer to construct substructure facilities required to serve a development. <br />Electric substructure Installed in accord with Construction By Developer (CBD) policy must comply with the CBD Handbook, <br />approved drawings, standards and material specifications. All workwill be Inspected, and Installations that do not complywill not be <br />energized. Once accepted, electric substructure installed by the CBD policy becomes the property of E WEB.
