Master Certification Agreement No. 24651 <br />AMENDMENT NO. 2 <br />Oregon Department of Transportation <br />LOCAL AGENCY CERTIFICATION PROGRAM <br />American Recovery and Reinvestment Act of 2009 <br />Supplemental Project Agreement No. 25565 <br />2010 Pavement Preservation Program <br />City of Eugene <br />The STATE OF OREGON, acting by and through its Department of Transportation, <br />hereinafter referred to as "State"; and CITY OF EUGENE, acting by and through its <br />designated officials, hereinafter referred to as "Agency", entered into Local Agency <br />Supplemental Project Agreement No. 25565 on June 2, 2009, and Amendment No. 1 on <br />February 2, 2010. Said Agreement covers the preliminary engineering and construction <br />of pavement rehabilitation of Garfield Street, High Street, Crescent Avenue and West <br />First Avenue, also known as the 2010 Pavement Preservation Program, hereinafter <br />referred to as "Project". <br />It has now been determined by State and Agency that the Agreement referenced above <br />shall be amended to remove ARRA funding of $2,181,890, designated for Project <br />construction, and add State funds toward construction of the Project. The $2,181,890 will <br />be applied toward State's Region 2 Illumination Project (Key No. 13794). Except as <br />expressly amended below, all other terms and conditions of the Agreement are still in full <br />force and effect. <br />TERMS OF AGREEMENT, Paragraph 3, Page 2, which reads: <br />3. The Project shall be conducted as a part of the ARRA Program under Title 23, United <br />States Code. The total Project cost is estimated at $2,236,000, which is subject to <br />change. ARRA Program funds for this Project shall be limited to $2,236,000. The <br />Project will be financed with ARRA funds at 100 percent of the maximum allowable <br />federal participating amount. Agency will not be required to provide a match for the <br />ARRA funds but will be responsible for any non-participating costs, including all costs <br />in excess of the available federal funds. No ARRA funded invoices will be accepted <br />and no ARRA funded payments will be made after September 30, 2015. <br />Shall be deleted in its entirety and replaced with the following: <br />3. The total Project cost is estimated at $2,236,890, which is subject to change. <br />a. A portion of the Project shall be conducted as a part of the ARRA Program under <br />Title 23, United States Code. ARRA Program funds for this Project shall be limited <br />to $55,000 and are for preliminary engineering services. ARRA funds will be <br />financed at 100 percent of the maximum allowable federal participating amount. <br />Agency will not be required to provide a match for the ARRA funds but will be <br />Key No. 16427 <br />
