<br />TRADE SERVICES CONTRACT <br />(Non-Facility) <br />BETWEEN: The City of Eugene, an Oregon <br />Municipal Corporation <br />AND: Green Ridge Concrete <br />CONTRACT NO.: 2010 - 05325 <br />EFFECTIVE <br />DATE: April 20, 2010 <br />(City) <br />(Contractor) <br />RECITALS <br />A. Contractor is engaged in the business of concrete work, and has obtained and currently <br />holds all licenses, permits, certifications, bonds or other authorization required by Federal, <br />State or local law or regulations to engage in such business. <br />B. City desires to engage Contractor to perform the services described in the attached Exhibit <br />D (the "Services"). Contractor has represented that it is qualified to perform the Services, <br />and desires to enter into this contract with City on the terms set forth below. <br />AGREEMENT <br />Engagement. City hereby engages Contractor to perform the Services, and Contractor <br />agrees to perform the Services, according to the terms and conditions set forth herein and <br />in the following exhibits: <br />Exhibit A -City of Eugene .Standard Contract Provisions <br />Exhibit B -Description of Services and Bid by Contractor <br />2. Term. The term of this contract shall be for concrete work at the Water Wise Garden in <br />Alton Baker Park per bid and details provided in Exhibit B. unless earlier terminated in <br />accordance with paragraph 16. <br />3. Consideration. As consideration for performance of the Services, City shall pay <br />$$5,310.00 to Contractor within 30 days of completion of performance of the Services to <br />the satisfaction of City. Except as expressly set forth herein, Contractor shall bear all <br />expenses of performing the Services. <br />4. Equipment. Contractor shall provide all materials, equipment, supplies or other items <br />required for performance of the Services. The City shall provide excavation services of the <br />site. <br />5. Contract Administration. Each party designates the following as its representative for <br />purposes of notice pursuant to paragraph 23, and for purposes of administering this <br />contract: <br />Non-Facility Trade Service Contract--Page 1 <br />(Revised December 1997) <br />
