ADMINISTRATIVE ORDER N0.58-10-03 of the City Manager of the City of Eugene CONCERNING NOTICE OF INTENDED AMENDMENT TO THE WASTEWATER USER FEE SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER N0.58-09-06-F. The City Manager of the City of Eugene finds as follows: A. Secfion 6.411 of the Eugene, Code, 1971; authorizes the City Manager to line and set fees and chazges to be imposed by the City for wastewater service, regional eater service, and stormwater service. Pursuant to that authority, on May 26, 2009, I Administrative Order No. 58-09-06-F amending the Wastewater User Fee Schedule, became effective and final on June 6, 2009, for bills issued on or after July 1, 2009. B. In accordance with subsection (1) of Secfion 6.411 of the Eugene Code, 1971, I 'e conducted an investigation of the revenue needs of the City in providing wastewater vices. I propose to amend the Wastewater User Fee Schedule based on the results of that estigation and the following criteria: (1) the amount chazged for the services in the past; (2) recommendation of the Metropolitan Wastewater Management Commission (MWMC); (3) dicable federal and state regulations; (4) amounts chazged by the City of Springfield and other h service providers for comparable services; (5) the revenue needs for costs related to local t regional sewerage facilities; (6) other relevant adopted policies of the council; (7) the terms any applicable intergovernmental agreement relating to wastewater; (8) obtaining equity ween different classes of ratepayers; and (9) the value of the use and occupancy of the City's it-of--way by the City wastewater system. C. Based on my investigation and MWMC's recommendation, Ipropose to amend wastewater user fees as set forth in the Notice of Intended Amendment of Wastewater User Schedule attached as Exhibit A. The amendments should be implemented and effective for bills issued on or after July 1, 2010. On the basis of these Endings, I order that: 1. Copies of the Notice be provided to the Mayor and City Councilors, the news any person who has requested notice, to interested governmental agencies (including the States Environmental Protection Agency, the Department of Environmental Quality, the ~olitan Wastewater Management Commission, and the Eugene Water & Electric Board), at'two locations at City Hall, published on two separate occasions in the Register Guazd, a per of general circulation within the City, and be made available for inspection by ed persons at the offices of the Public Works Department, 101 E.
