ADMINISTRATIVE ORDER N0.58-10-03 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT TO THE <br />WASTEWATER USER FEE SCHEDULE AND REPEAL OF <br />ADMINISTRATIVE ORDER N0.58-09-06-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Secfion 6.411 of the Eugene, Code, 1971; authorizes the City Manager to <br />line and set fees and chazges to be imposed by the City for wastewater service, regional <br />eater service, and stormwater service. Pursuant to that authority, on May 26, 2009, I <br />Administrative Order No. 58-09-06-F amending the Wastewater User Fee Schedule, <br />became effective and final on June 6, 2009, for bills issued on or after July 1, 2009. <br />B. In accordance with subsection (1) of Secfion 6.411 of the Eugene Code, 1971, I <br />'e conducted an investigation of the revenue needs of the City in providing wastewater <br />vices. I propose to amend the Wastewater User Fee Schedule based on the results of that <br />estigation and the following criteria: (1) the amount chazged for the services in the past; (2) <br />recommendation of the Metropolitan Wastewater Management Commission (MWMC); (3) <br />dicable federal and state regulations; (4) amounts chazged by the City of Springfield and other <br />h service providers for comparable services; (5) the revenue needs for costs related to local <br />t regional sewerage facilities; (6) other relevant adopted policies of the council; (7) the terms <br />any applicable intergovernmental agreement relating to wastewater; (8) obtaining equity <br />ween different classes of ratepayers; and (9) the value of the use and occupancy of the City's <br />it-of--way by the City wastewater system. <br />C. Based on my investigation and MWMC's recommendation, Ipropose to amend <br />wastewater user fees as set forth in the Notice of Intended Amendment of Wastewater User <br />Schedule attached as Exhibit A. The amendments should be implemented and effective for <br />bills issued on or after July 1, 2010. <br />On the basis of these Endings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, the news <br />any person who has requested notice, to interested governmental agencies (including the <br />States Environmental Protection Agency, the Department of Environmental Quality, the <br />~olitan Wastewater Management Commission, and the Eugene Water & Electric Board), <br />at'two locations at City Hall, published on two separate occasions in the Register Guazd, a <br />per of general circulation within the City, and be made available for inspection by <br />ed persons at the offices of the Public Works Department, 101 E.
