Master Certification Agreement 24651 <br />City of Eugene Contract No. 2009-00261 <br />AMENDMENT NO. 1 <br />Oregon Department of Transportation <br />LOCAL AGENCY CERTIFICATION PROGRAM <br />American Recovery and Reinvestment Act of 2009 (1 R-Paving) <br />Supplemental Project Agreement No. 25723 <br />Crescent Avenue: North Game Farm Road - Shadow View Drive <br />City of Eugene <br />The STATE OF OREGON, acting by and through its Department of Transportation, <br />hereinafter referred to as "State"; and CITY OF EUGENE, acting by and through its <br />designated officials, hereinafter referred to as "Agency", entered into Local Agency <br />Supplemental Project Agreement No. 25723 on May 26, 2009. Said Agreement covers a <br />two-inch (2") pavement overlay in accordance with 1 R Guidelines. <br />It has now been determined by State and Agency that the Agreement referenced above, <br />shall be amended to correct inconsistencies in the Agreement language, remove ARRA <br />construction phase funds, and reduce the total Preliminary Engineering (PE) phase ARRA <br />funding by $29,000. The $29,000 will be applied to Agency's 11th Avenue and 13th Avenue <br />Paving ARRA contingency project, Agreement No. 26415. <br />ARRA funds designated for construction of the Project, totaling $305,000, were combined <br />into Agency's 2010 Pavement Preservation Program: Garfield Street, High Street, <br />Crescent Avenue and West First Avenue project (ODOT Key No. 16427), as defined in <br />Agreement No. 25565. This Amendment will address the reduction of ARRA funds <br />designated for the PE phase. Except as expressly amended below, all other terms and <br />conditions of the Agreement are still in full force and effect. <br />TERMS OF AGREEMENT, Paragraph 1, Page 1, which reads: <br />1. Under such authority, Agency agrees to pave various streets or roads as further <br />identified and shown in the map attached hereto, marked "Exhibit A", and by this <br />reference made a part hereof, hereinafter referred to as "Project". The Project will <br />consist of a pavement overlay in accordance with 1 R guidelines on Crescent Avenue <br />from Game Farm Road to Shadow View Drive. <br />Shall be deleted in its entirety and replaced with the following: <br />1. Under such authority, Agency agrees to perform preliminary engineering for Agency's <br />pavement overlay of Crescent Avenue from Game Farm Road to Shadow View Drive, <br />in accordance with 1 R Guidelines, hereinafter referred to as "Project". The location of <br />the Project is shown on the map attached hereto, marked "Exhibit A", and by this <br />reference made a part hereof. <br />Key No. 16443 <br />
