3 <br />City of Eugene Contract #2010-00227 i <br />~ INTERGQVERNMENTALRGREEMENT <br />THIS AGREEMENT entered into by and between Lane Council of Governments, an E <br />organization of governments within Lane County, Oregon, hereinafter referred to as LCOG, and Cit of Eu n I ' <br />~ y ge e, a ocal municipality of the State of Oregon, hereinafter referred to as CITY, i <br />s WHEREAS, ORS 190.010 provides that units of Iota! governments may enter into agreements <br />for the performance of~any or all functions and activities that a party to the agreement, its <br />officers or agents, have the authority to perform; and <br />~ ~ WHEREAS, LCOG and CITY Public Works have agreed that CITY shall provide technical <br />E ~ assistance to LCOG as outlined in Article 1 below; and <br />WHEREAS, the cost of these services to LCOG shall not exceed $4,000. <br />NOW, THEREFORE, it is agreed that: <br />3 <br />1, CITY shall rovide LCOG with u to a rvx'rmatel 44 hours of technical assistance in p p pP y <br />support of the Corps Metro Waterways Study related to estimating costs of associated <br />land acquisitions and easements. This work will be coordinated through CITY's Senior <br />Real Property Officer, Russ Royer and may include other staff under h`rs supervision as <br />needed. <br />2. The agreement term shall be November 1, 2009 through March 1, X010. <br />3. LCOG shall pay CITY on receipt of an invoice at .project completion. The invoice will be sent to Jeff Krueger, Senior Landscape Architect, for approval and shall include total <br />hours and project costs. The fatal cost of this agreement shall not exceed $4,000. <br />4. Each party working under this agreement is either a subject employer under the Oregon <br />Worker's Compensation Law and shalt comply with ORS 656.01?, which requires each <br />to provide Worker's Compensation coverage far all its subject workers, or is an I <br />employer that is exempt under ORS G56.126. <br />E <br />S. This agreement may be modified or extended by written amendment signed by both <br />parties. <br />6.
