CONTRACT FOR PAYMENT OF SERVICES <br /> BETWEEN: The City of Eugene, a unit of local (City) <br /> government of the State of Oregon <br /> AND: Avalon Village Homeowner's Association, <br /> An Oregon Non-Profit Corporation (Agency) <br /> CONTRACT NO.: 2010 - 00214 <br /> EFFECTIVE DATE: September 25, 2009 <br /> RECITALS <br /> A. The City is bidding out a project to install three (3) traffic calming devices (speed humps), <br /> associated signs, and markings on Praslin Street within the Avalon Village development at <br /> the request of the Avalon Village Homeowner's Association. The Avalon Village <br /> Homeowner's Association agrees to provide funding for the installation of three speed <br /> humps, associated signs and markings up to $12,000. The solicitation will request bids for <br /> line items. The work to install the three speed humps, associated signs, and markings will <br /> be billed to the Agency at the line item unit prices (up to $12,000). City will maintain the <br /> traffic calming devices following installation. <br /> B. It will mutually benefit the parties if they exchange services as described in this contract. <br /> C. City and Agency desire to enter into a contract whereby each will provide the services <br /> described in this contract on the terms and conditions set forth herein and in the following <br /> exhibit: <br /> Exhibit A -City of Eugene Standard Contract Provisions <br /> AGREEMENT <br /> 1. Services to be Provided. City and Agency each agree to provide services as described <br /> in this contract. City will manage the solicitation of bids and work completion, Agency will <br /> provide funding for three speed humps,' associated signs, and markings at cost to City. <br /> 2. Time for Completion. City anticipates issuing bid solicitation by September 30, 2009. <br /> City will keep Agency informed of progress. Notification of work commencement will be <br /> provided 3 days prior to work start date. Agency shall provide payment for services within <br /> 30 days of invoice receipt. <br /> <br /> 3. Termination. Prior to solicitation issuance, upon three days' prior written notice delivered <br /> to the persons designated in paragraph 4, either party, may terminate its participation in <br /> this contract. <br /> <br />
