NONDISCRIMINATION AGREEMENT FOR CERTIFIED LOCAL <br /> AGENCIES <br /> Assurances: <br /> In accordance with Title VI of the Civil Rights Act of 1964 and subsequent federal <br /> nondiscrimination directives such as the Federal-Aid Highway Act of 1973, the Rehabilitation Act <br /> of 1973, the Age Discrimination Act of 1975, the Civil Rights Restoration Act of 1987, Americans <br /> .with Disabilities .Act of 1990 (ADA), Executive Order 12898 (Environmental Justice), and <br /> Executive Order 13166. (Limited English Proficiency), the City of Eugene Public Works <br /> Engineering Department, hereinafter referred to as the "Local Agency," assures that no person <br /> .shall on the grounds of race, color, national origin,. Limited English Proficiency, sex; income, <br /> age, or disability, be excluded#rom participation in, be denied the benefits of, or be otherwise <br /> sub'ected to dis <br /> crimination under an ro ram or activit whether it is_fed r II f " <br /> 1 y p g y e a y unded or not. <br /> Additionally, under Executive -Order 12898 and proceeding USDOT/FHWA directives, the Local <br /> Transporkation Agency shall make every reasonable effort to identify and address, as <br /> appropriate, disproportionately high and. adverse human heath or environmental effects of the <br /> Local Transportation Agency's programs, policies, and activities on minority populations and <br /> low-income populations. <br /> The Local Transportation Agency further agrees to the following responsibilities with respect to <br /> its federal transportation programs and activities: <br /> 1. Designate a Title VI Coordinator: who has a responsible position within the :organization <br /> and .access to.the Local Transportation Agency's Administrator [or other head official]. <br /> <br /> . The Local Transportation Agency shall notify ODOT's Office of .Civil Rights within a <br /> reasonable- time of any personnel changes in the. Title VI Coordinator position. It is the <br /> responsibility of the Local. Transportation Agency to ensure that any subsequent Title VI <br /> ..Coordinators to maintain. up-to-date. and accurate knowledge of this agreement, Title VI <br /> of the Civil Rights Act of 1964, and other related laws and directives. <br /> 2. Issue. a policy statement signed ;.by the .Administrator [or other head official], .which <br /> ..expresses its commitment to the nondiscrimination provisions of Title VI and other related <br /> laws and ,directives.. The ,policy. statement shall be .circulated throughout the. Local <br /> Transportation Agency's organization and to the general public. Such information shall be <br /> published where appropriate in languages other than English. <br /> 3. Insert the clauses of Appendix 8 of this .agreement in every contract subject to Title VI <br /> compliance. <br /> 4. Develop a complaint process and attempt to resolve complaints of'discrimination against <br /> sub-recipients or contractors. Complaints against the Local Transportation Agency shall <br /> be immediately forwarded to ODOT's Office of Civil Rights. A11 other complaints shall be <br /> investigated and submitted to ODOT's Office of Civil Rights no later than sixty (60) <br /> calendar days after the complaint was filed with the Local Transportation Agency. <br /> 5. Participate in trainings on Title VI and other nondiscrimination authorities for the Local <br /> Transportation Agency's employees and their sub-recipients of federal highway funds. <br /> 6. Take action to correct any deficiencies found by ODOT or FHWA within a reasonable <br /> period of time, not to exceed ninety (90) calendar days. <br /> 7. For each of the following major program areas, if applicable, summarize how Title VI <br /> monitoring will be accomplished by the Local Transportation Agency: <br /> a.
