INTERGOVERNMENTAL AGREEMENT <br /> For <br /> Surface Maintenance Services <br /> City of Eugene <br /> THIS AGREEMENT is `entered- into by and between LANE COUNTY, a political subdivision of the State of <br /> .Oregon,. hereinafter referred to as COUNTY, and CITY OF EUGENE, a municipal corporation, hereinafter <br /> referred to as CITY. <br /> RECITALS <br /> . WHEREAS, ORS 490.010 and the Lane County Home Rule Charter provide that units of local government <br /> may enter into agreements for the performance of any or all functions and activities that a party to the <br /> agreements, its officers or agents, have authority to perform; and <br /> WHEREAS, ORS 373.260(1)(a) provides that counties and cities may enter into intergovernmental agreements <br /> for the construction; improvements or repairs of, any city system within the corporate limits of the CITY, and <br /> WHEREAS, COUNTY and CITY have determined that it is both to their. mutual benefit and to the general . <br /> public's benefit if they jointly utilize maintenance resources, including. equipment and operators, and <br /> WHEREAS, Under such authority, COUNTY and CITY desire to enter into an agreement where COUNTY <br /> owned maintenance equipment operated by COUNTY personnel will provide surface maintenance services to <br /> CITY on terms and conditions mutually acceptable to both parties, and <br /> WHEREAS, Under-the limitations of the Oregon Constitution,. COUNTY may only perform work on <br /> . roadways and rights-of-ways dedicated to public use. COUNTY is expressly prohibited from expending <br /> road funds on private roads. <br /> AGREEMENTS. <br /> Inconsideration of the mutual agreement of the parties hereto, the parties hereby agree as follows: <br /> 1. For the purpose of this agreement, CITY and COUNTY have determined a portion of Riverview <br /> Street and Floral Hill Drive needs surface maintenance. <br /> <br /> - 2. CITY has requested COUNTY perform chipseal and fogseal services on Riverview Street and. <br /> Floral Hill Drive. <br /> COUNTY shall: <br /> 3. Furnish equipment, materials, and personnel to perform surface maintenance. services on streets <br /> designated by CITY. It is understood by both parties COUNTY may be unavailable to provide services to <br /> CITY during certain times due to its workload. <br /> Intergovernmental Agreement -Surface Maintenance Services <br /> City of Eugene/Lane County - 1 - <br /> <br />
