PAYMENT TO PROVIDE MITIGATION CHECKLIST AND WORKSHEET <br /> Modified Apri112, 2002 <br /> Resource Coordinator: Morrow <br /> County: Lane <br /> File Number: Enf. #5288 <br /> OAR 141-085-0310 Policies (Important Points to Remember) <br /> Payment to Provide Compensatory Mitigation shall not be allowed when the Oregon <br /> Department of Environmental Quality (DEQ) determines that a project requiring a <br /> -Removal-Fill Permit will cause more than a de minimis negative affect on parameters <br /> that limit water quality unless compensatory mitigation occurs within the impacted water <br /> quality basin <br /> <br /> i <br /> Payment to Provide Compensatory Mitigation shall not create a presumption that the <br /> proposed wetland impact is a permittable action, nor eliminate the requirement to fully <br /> demonstrate that the applicant has attempted to avoid and minimize wetland losses. <br /> Payment to Provide Compensatory Mitigation is the last resort after, restoration, <br /> creation, and enhancement of wetlands for compensatory mitigation. <br /> OAR 141-085-0325 Criteria for Allowing PTP Compensatory Wetland Mitigation <br /> - All of the following requirements must be satisfied: <br /> ¦ The freshwater wetland impact is one (1) acre or less; <br /> ¦ The wetlands to be lost are not protected by a local land use comprehensive plan; <br /> ? The applicant has considered alternatives, demonstrated avoidance, and minimized <br /> wetland impacts; <br /> ? The Director determines that compensatory. mitigation is not appropriate because <br /> (a) The sustainability of the mitigation site is low considering effects that adjacent <br /> land use(s) will have on the proposed mitigation; and <br /> (b) The proposed mitigation site is isolated from other waters of the state, and. <br /> ? The applicant has explored the potential of using a mitigation bank. <br /> OAR 141-085-0330 Information Requirements <br /> The applicant must supply the following information prior to DSL approval of a PTP <br /> project: <br /> • The total area of the wetland compared to the amount that will be lost <br /> • The Cowardin and hydrogeomorphic classifications of the wetland, which will be <br /> disturbed: Cowardin Class(es) PSS , HGM Class(es) <br /> • The functions exhibited by the wetland expected to be lost at the project site. This <br /> assessment shall, at a minimum, include a qualitative estimate of the wetland's: <br /> (a) Function as fish or wildlife habitat <br /> (b) Contribution to the water quality of waters of the state <br /> (c) Contribution to hydrologic control <br /> <br />
