City of Eugene /State <br /> <br /> Agreement No. 25396 <br /> 11. City's Project Manager for this Project is: Mark Schoening, PE, City Engineer, 101 E. <br /> Broadway, Suite 400 Eugene, OR 97401 Phone: 541-682-5291 or assigned designee <br /> upon individual's absence. State's Project Manager shall be notified in writing of any <br /> contact information changes during the term of this Agreement. <br /> STATE OBLIGATIONS <br /> 1. State, or its consultant, shall conduct the necessary field surveys, environmental <br /> studies, traffic investigations, preliminary engineering and design work required to <br /> produce and provide final plans, specifications and cost estimates for the Project; <br /> identify and obtain all required permits; perform all construction engineering, <br /> including all required materials testing and quality documentation; prepare all bid <br /> and contract documents; advertise for construction bid proposals; award all <br /> contracts; pay all contractor costs, provide technical inspection, project management <br /> services and other necessary functions for sole administration of construction <br /> contracts entered into for Project. <br /> 2. State shall be responsible for all costs associated with the Project. <br /> 3. State shall meet with City no less than once to coordinate planning, design, and <br /> construction implementation of Project as it relates to use of State right of way. <br /> 4. State shall repair or replace any damaged City street improvements to a better than, <br /> or same as pre-construction condition, should the State or State's contractors <br /> damage City street improvements resulting from the Project work. <br /> 5. State shall be responsible for all costs to relocate existing City-owned utilities if <br /> spatial conflicts occur within State's right of way, on that portion of Augusta Street <br /> lying northerly of 16th Avenue, resulting from the Project work. <br /> 6. There are existing non-City utilities within State right of way by permit. State shall <br /> be solely responsible for the on-going coordination and permitting of those non-City <br /> utilities within the State right of way. <br /> 7. State shall be responsible for on-going maintenance, repairs, and replacement of <br /> the Bridge, roadway, and associated permanent facilities within the State right of <br /> vvay on that portion of Augusta Street lying northerly of 16th Avenue. <br /> 8. State hereby grants City the right to enter onto and occupy State right of way for <br /> access to City utilities for repair, inspection, corrections, or replacement work <br /> provided City notifies State of proposed work, and is not in conflict with State's <br /> scheduled Project work. In cases of emergency repairs, State will not unreasonably <br /> 4 <br /> <br />
