City of Eugene /State <br /> Agreement No. 25396 <br /> TERMS OF AGREEMENT <br /> 1. Under such authority, City and State a~ree to State's use of 16t" Avenue and those <br /> portions of Augusta Street south of 16 Avenue for construction activities related to <br /> State's Project. Construction activities may include but shall not be limited to <br /> periodic construction traffic, short term parking of construction equipment and <br /> placement of construction materials. No lane closures will occur without additional <br /> approval from City of State's plans and duration. The location of the Project is <br /> approximately as shown on page 7 of the Right of Way Report, attached hereto, <br /> marked Exhibit A, and by this reference made a part hereof. <br /> 2. The estimated cost of the Project is $7,000,000. State shall be responsible for all <br /> Project costs. <br /> 3. This Agreement shall become effective on the date all required signatures are <br /> obtained and shall remain in effect for the purpose of ongoing maintenance <br /> responsibilities for the useful life of the City utilities, which exist within State right of <br /> way, and State utilities, which require the use of City right of way. The useful life is <br /> defined as twenty (20) calendar years. The Project shall be completed within ten <br /> (10) calendar years following the date of final execution of this Agreement by both <br /> Parties. <br /> CITY OBLIGATIONS <br /> 1. City shall meet with State at least once to coordinate planning, design, and <br /> construction implementation of Project as it relates to the use of State right of way. 5~~~°~ <br /> <br /> 2. City owns certain utilities including storm water sewers, sanita sewers, ~arad~water~~ <br /> ry <br /> des that are within the State's right of way on the portion of Augusta Street lying <br /> northerly of 16t" Avenue. City shall have access to these utilities, during construction <br /> of the Project, for repair, inspection, corrections, or replacement work provided City <br /> notifies State of proposed work, and is not in conflict with State's scheduled Project <br /> work. In cases of emergency repairs, State will not unreasonably withhold right of <br /> way access to City, and shall work to accommodate City's emergency. <br /> <br /> 3. Upon completion of the Project and at its own expense, City shall continue to <br /> perform the necessary ongoing maintenance of the City-owned utilities as stated in <br /> the paragraph above. <br /> 2 <br /> <br />
