The Catalog of federal Domestic Assistance <br /> ~CfDA} number and title for this Project is X0.20, Highway Planning and <br /> Construction. <br /> 8. if Agency fails to meet the requirements of this Agreement or the underlying federal <br /> regulations, State may withhold the Agency's proportional share of I~ihway fund <br /> distribution necessary to reimburse State for costs incurred by such Agency breach, <br /> Agency, a a recipient of federal funds, pursuant to this Agreement with State, shall <br /> assume sole liadility for Agency's breach of any federal statutes, rules, program <br /> requirements and grant provisions applicable to the federal funds, and shall, upon <br /> Agency} breach of any such conditions that requires State to return funds to the <br /> fHwA, hold harmless and indemnify State for an ernaunt equal to the funds received <br /> under this Agreement; or if legal limitations apply to the indemnification ability of <br /> Agency, the indemnification amount shall be the maximum amount of funds available <br /> for expenditure, including any available contingency funds or other available nonW <br /> appropriated funds, up tothe amount received under thisAgreernent, <br /> ~ Agency shall select consultants, design, advertise, bid, award the construction <br /> contract, and provide construction administration. Agency understands that this <br /> Project is a test project and agrees to amply with all of the terms and conditions <br /> found in Certification Program Agreement No. 24~~~ . <br /> ~ ~ ~ Agency shall place signs that identify Project as `{American Recovery and <br /> Reinvestment Act of o0g" State approved design} as described in the oDCT <br /> Technical bulletin TRO9-p2~~~ for most current version} titled "Project Identification <br /> Sign for oDCT economic Stimulus projects"~ Agency may affix additions! signage that <br /> identifies Agency funds used for the Project. <br /> ~ . Agency shah report to State the data required by federal and State mandates for <br /> delivery of the ARRA program. State shall inform the local agencies of the reporting <br /> requirements once they have been received from ~l~lvUA and the oregon Department <br /> of Administrative Services; and such reguirerr~ents shall be made a part of this <br /> Agreement, <br /> <br /> ~Flf Project involves pavement overlay on a bridge, Agency shall either: ~a} load rate the <br /> bridge when adding two inches of pavement depth to an existing bridge deck to <br /> determine the capacityof the bridge; orb} remove two inches of Asphalt Concrete <br /> ~AC~ from the bridge deck and then place two ~2} inches back for a zero net gain of <br /> Asphalt Concrete din-layover-lays on the bridge deck. Agency shall then sawcut the <br /> P~g~ of 8 <br /> <br />
