State may canduct periodic inspections during the life of Agency certification Projects <br />to verify that Project i being properly n~ainteined and continues to serve the purpose <br />far which federal funds were provided. <br />~ 8. State may terminate this Agreement effective upon delivery of written notice to <br />Agency, or at such inter date ~ may be established by State, under any of the <br />follovuin conditions: <br />~, if Agency fails to provide services called far by this Agreer~ent within the time <br />specified herein or any extension thereof <br />b. if Agency fails to perform any of the other provisions of this Areetent, ar so fails <br />to pursue the work ~ to endanger performance of this Agreement in accordance <br />with its terms, and after receipt of vuritten nonce from State fa~is to correct such <br />failures within ton ~1a~ days or such Conger period as State nay authori~e~ <br />c. if Agency fails to provide payment of its share of the cost of the Project. <br />d. If State fails to receive funding, appropriations, limitations or other expenditure <br />authority sufficient to allow State, in the exercise of its reasonable administrative <br />discretion, to continue to make payments for perfarrnance of this Agreement. <br />e. if federal or state laws, regulatians or guidelines are modified or interpreted in <br />such a way that either the work under phis Agreement is prohibited or if State is <br />prohibited from paying far such warlc frorr~ the planned funding source, <br />~g.Because of the A~~A funding requirements, Agency must advance the Project for <br />abl'rgatian of funds prior to March ~, ~o~o; and State must make determination no <br />Cater than December ~~, ~~~ whether this date will be r~et.
