NOTICE OF INTENDED RULEMAHING <br />,__ <br />PROPOSED AMENDMENT OF INDUSTRIAL <br />,PRETREATMENT PROGRAM ADMIl~TISTRATIVE RULE <br />__ NOTICE I5 HEREBY GIVEN that pursuant to the authority contained in Sections 2.019 <br />and 6.501 of the Eugene Code, 1971, the City Manager pro tem of the City of Eugene, intends to <br />amend the Administrative Rule to: . <br />(1) Change the rule number from R-6.463 to R-6.501 in order to tie the rule <br />number to its corresponding Code section. (Section 6.463 of the Eugene Code, 1971, and <br />other Industrial Pretreatment Program Code sections, were previously amended and <br />renumbered. Section 6.501 ofthe Eugene Code, 1971, authorizes the City Manager to "adopt <br />and to promulgate as regulations any laws of the state or the federal government in <br />accordance with the procedures of section 2.019 of this code.") <br />(2) R-6.501-B. Amend amounts ofRestricted Substance Limitations; delete "Oil <br />and Grease, Total" from the list; and change the name of "Oil and Grease, Hydrocarbon" to <br />"Silica Gel Treated Hexane Ext. Material." <br />(3) R-6.501-C. Eliminate the requirement to prorate the initial permit fee and <br />change the due date of the annual permit fee to August 1. <br />r--, <br />(4) R-6.501-D. Due to the renumbering of the Eugene Code, change the Code <br />section references in subsections 1(b); 2(c) and (e); and 3(b), (c) and (d). In subsection 2(f), <br />eliminate the requirement that notices/orders be served by certified mail, and, at the end of <br />the last sentence in the section, change "without" to "outside" as follows: "..., if to an <br />address outside this state." Make the same changes to subsection 3(e). <br />(5) Appendix A -Industrial Pretreatment Pro~xam Enforcement Response Guide. <br />Adjust Nature of Violation, Response, Penalty and Personnel sections. Amend "Notes" <br />sections 1 and 3, and add sections 12 and 13. <br />Adoption of the proposed amendment of the Industrial Pretreatment Program Administrative <br />Rule is necessary in.order to ensure that the Eugene Code sections cited in the Rule reflect the Code <br />sections that have been renumbered; update the names and limitations of specific restricted <br />substances discharged; eliminate the requirement to prorate the initial permit fee and change the date <br />that the annual permit fee is due; and eliminate the requirement that service for all notices/orders be <br />by certified mail because many businesses use 1? O. boxes and do not pick up the certified mail after <br />receiving notification by first class mail. The Rule may be reviewed at the Public Works <br />Department, Administration Division, 858 Pearl Street, Eugene, Oregon 97401, during normal <br />business hours (8:00 a.m. to 5:00 p.rti., Monday through Friday, exclusive of holidays). <br />All persons wishing to comment thereon or object thereto must submit their comments or <br />~' objections to the City's Public Works Department, Administration Division, 858 Pearl Street, <br />Notice <br />C:\User\ADMII~IORD\02IndusirialPretreatment Notwpd <br />
