satisfactory to the City, and expressly providing that the interest of the City shall not <br />l be affected by the operator's breach of the policy provisions. <br />6.3.15.3 Worker's Compensation Insurance. The operator shall comply with <br />the Oregon worker's compensation law by qualifying as acarrier-insured employer or <br />as aself-insured employer and shall strictly complywith all other applicable provisions <br />of such law. The operator shall provide the City with the assurances that the City may <br />require that the operator is in compliance with the worker's compensation law. This <br />rule is not intended to require worker's compensation by an operator for agents, when <br />that coverage is not required by state law. <br />6.3.16 Indemnification. An operator shall indemnify and hold the City of Eugene and <br />its officers, agents and employees, harmless from and against all claims, actions, liabilities, <br />costs, including costs of defense, arising out of or in any way related to the operator's activities <br />at the Airport, the operator's failure to comply strictly with any provision of these rules or of <br />the operator's lease or permit with the City, or of any other actions or failure to act by the <br />operator and the operator's employees, agents, officers and contractors. In the event any such <br />action or claim is brought against -the City, the operator shall, if the City so elects and upon <br />tender by the City, defend the same at the operator's sole expense and cost, promptly satisfy <br />-any judgment adverse to the City or to City and operator jointly, and reimburse the City for any <br />loss, cost, damage or expense suffered or incurred by the City, including any legal fees, or fines <br />paid to the FAA or any other governmental agency arising from the operator's activities. <br />6.3.17 Vending Machines. An operator shall not install or operate vending machines, <br />pay telephones, coin-operated amusement machines or devices in or upon any leased premises, <br />except as approved by City. City specifically reserves the right to arrange for the installation <br />`~ --' of such machines or devices and such other concessions as the City may desire. <br />6.3.18 National Emer eg ncies. During time of war or national emergency, the City <br />shall have the right to lease the Airport, or any part of the Airport to the United States for <br />military use. Any permit, lease, or authority granted under these rules shall be subject to and <br />controlled, in the event of inconsistency, by that government lease. <br />6.3.19 Existing and Future Government A>;reements. Any permit, lease, or agreement <br />entered into under these rules shall be subject to the terms of the sponsor's assurances and <br />agreements now required or imposed in the future between the City and the FAA or its <br />successor, any existing or future agreement between the City of Eugene and the United States, <br />and to any directive from the FAA or its successor to the City, relative to the operation or the <br />maintenance of the Airport or the obtaining of federal grants. <br />6.3.20 Airport Layout Plan/Airport Master Plan. The City reserves the right to make <br />changes in the Airport Layout Plan and Airport Master Plan. The City reserves the power to <br />designate as common use areas any areas which have not been specifically leased or reserved <br />to any person or party by a written agreement. <br />6.3.21 City Use of Leased Land. The City has the right to temporarily occupy any part <br />of an area which has been leased or reserved to any person by a written agreement, so long as <br />the City use does not interfere with the principal use of the land by the lessee or permittee.
