ADMINISTRATIVE ORDER NO. 58-03-07-F <br />~~~~~~~ of the <br />` City Manager <br />AMENDING AIRPORT RULE 2, 4.15.7, 5.3, 5.4, 6.3.15.1, 6.3.15.2, AND 7, <br />EFFECTING ADMINISTRATIVE CORRECTIONS TO OTHER SECTIONS, <br />AND REPEAL OF ADMINISTRATIVE ORDER NOS. 58-95-O1 AND 58-98- <br />09-F. <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the authority contained in Sections 2.019 and 2.430 of the Eugene Code, <br />1971, Rules Governing the Use of Mahlon Sweet Airport ("Airport Rules") were adopted by <br />Administrative Order No. 58-95-O1 of the City Manager on March 31,.1995, and amended in part <br />by Administrative Order No. 58-98-09-F on June 19, 1998. <br />B. Pursuant to that authority and based on the findings contained in Administrative <br />Order No. 58-03-0.7 issued on April 16, 2003, I notified the Mayor and City Councilors that I <br />proposed to amend Section 5.4 of the Airport Rules to add new regulations for self-service fueling <br />facilities; add new definitions to Section 2; rewrite other portions of Section 5.4 to more specifically <br />identify the applicability of those provisions to the different types of fueling activities; amend <br />Section 4.15.7 to clarify requirements for fire extinguishers; move, amend and renumber Subsection <br />5.4.2.15 to 5.3.10; increase liability insurance coverages from $500,000 to $1,000,000; and that the <br />caption of Subsection 7.1 of Section 7 of the Airport Rules be amended. <br />C. Notice ofthe proposed amendments was also given bymaking copies available to any <br />person who had requested such notice and by publication thereof in the Register Guard, a newspaper <br />of general circulation within the City for five consecutive days, to wit: April 21, 22, 23, 24, and 25, <br />2003. The Notice provided that written comments would be received for a period of 15 days from <br />the date of the first publication. No comments were received within the time or in the manner <br />provided in the notice. However, during the comment period, staff recommended that revisions be <br />made to Sections containing requirements for grounding, and a new Section 5.4.8 be added to reflect <br />Uniform Fire Code changes in bonding and grounding requirements. Staff has also recommended <br />some administrative corrections to correct outdated or incorrect references. I concur with the <br />recommendations and the revisions have been incorporated in the Rules hereinafter set forth. <br />Based upon the above findings, which are hereby adopted, and pursuant to the authority <br />contained in Sections 2.019 and 2.430 of the Eugene Code, 1971, I hereby adopt the amendments <br />as noted above, repeal Administrative Order Nos. 58-95-O1 and 58-98-09-F as of the effective date <br />of this Order, except Exhibit A to Order 58-95-01 and Exhibit 2 to Order 58-98-09 shall be appended <br />to this Order, and ratify and affirm the unamended portions of the Airport Rules as hereinafter set <br />forth. <br />Administrative Order - 1 <br />r:\adminord\rules\03airr12ao.wpd(OS/16/03) <br />
