ADMINISTRATIVE ORDER N0.58-03-11-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF FEES FOR ENGINEERING SERVICES FOR <br />PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS; AND REPEAL <br />OF ADMINISTRATIVE ORDER N0.58-01-17-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. In accordance with the procedures set forth therein, and the further <br />authority of Section 7.130 of the Eugene Code, 1971, fees for engineering services for privately <br />constructed public improvements were established byAdministrative OrderNo. 58-01-17-F on July <br />11, 2001. <br />_ B. Pursuant to that authority, on June 24, 2003, I issued Administrative Order No. S 8-03- <br />11 and notified the Mayor and City Council that, effective July 14, 2003, Lintended to amend the <br />,,' fees for engineering services for privately constructed public improvements, which were established <br />by Administrative Order No. 58-01-17-F, as set forth in the Notice attached thereto. <br />C. The Notice was also posted at two locations at City Hall on June 26, 2003, and made <br />available for inspection by interested persons at the offices of the City Manager, 777 Pearl Street, <br />Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p:m. Monday through <br />Friday, exclusive of holidays). The Notice provided that written comments would be received for <br />a period of 15 days from the date of posting. No comments were received within the time or in the <br />manner required by the Notice. <br />D. I find that amendments to the fees for engineering services for privately constructed <br />public. improvements are necessary in order to comply with the requirements of Section 7.130 of the <br />Eugene Code, 1971, that the fees charged for those services recover the City's costs, including <br />overhead, engineering, inspection and review services performed by the City. In determining the <br />fees, I have considered the applicable policies, enactments and directives of the City Council, the <br />amount charged for these services by the City in the past, the full costs of providing these services. <br />supported by the fees, the amounts charged by other comparable providers, the revenue needs of the <br />City as determined by the adopted City budget, and the hourly rates of engineering employees for <br />the 2003-2004 fiscal year. <br />E.
