This work is <br />part of the process I'm working through with the City Attorney's office on updating the park rules <br />administrative order and is felt to be of a house keeping nature. While the needed authority may <br />already be in place, it was recommended we ensure clarity through being specific on two items in a <br />new delegation order. <br />1. The current delegation order is clear the Public Works Director has authority to establish <br />rules for park land, but it is not specific that "open spaces" fits within that category. Since <br />we often talk about "Parks" and "Open Space" as two separate items in our communications <br />and even in the title for the POS division it was felt we should clarify the delegation order to <br />be specific that park "open space" was included. <br />2. The second item is to clarify that the Public Works Director can further delegate if needed. <br />This change was recommended by the City Attorney's office to facilitate changes we wish to make in <br />the park exclusion hearing process. In conjunction with Muni Court, we have developed a new park <br />exclusion process which will deal with some of timeliness and coordination problems we had last <br />summer managing these infrequent appeals. <br />The new procedure requires the initial appeal to be heard by the Park and Open Space Division <br />Manager instead of the Public Works Director. The change will allow us a better ability to meet the <br />very short 48 hour requirement from time of request for conducting the hearing. We also will change <br />the secondary appeal from a Hearings Official process to Muni Court. This will be more efficient <br />since Muni Court usually becomes involved anyway due to a police citation also being issued. <br />Having them also deal with the potential secondary appeal at the same time eliminates the need for <br />the additional staff involvement setting up a process for a Hearings Official. <br />cc: Kurt Corey <br />
