NOTICE OF INTENDED RULEMAHING <br />PROPOSED AMENDMENT OF CONSTRUCTION <br />WITHIN AND USE OF THE PUBLIC WAY ADMINISTRATIVE <br />RULER 7.302 AND EXHIBIT A THERETO, <br />AND REPEAL OF ADMINISTRATIVE ORDER N0.58-00-13-F <br />s <br />NOTICE IS HEREBY GIVEN that pursuant to the authority contained in Sections 2.019 <br />and 7.302 of the Eugene Code, 1971, the City Manager of the City of Eugene, intends to amend <br />Construction Within and Use of the Public Way Administrative Rule R-7.302, and the Manual <br />attached as Exhibit A thereto adopted by Administrative Order No. 58-00-13-F on September 27, <br />2000, to: <br />(a) Reformat and clarify some provisions; <br />(b) Clarify and revise the notice requirements with respect to -the frequency of <br />opening of public ways; <br />(c) Provide additional provisions relating to temporary surfacing permits; <br />(d) Revise location standards and other provisions to ensure compatibility with <br />street tree planting and erosion provisions of the Eugene Code, 1971 and related <br />administrative rules. <br />The amendment of Construction Within and Use of the Public Way Administrative Rule R- <br />7.302 and the Manual attached as Exhibit A thereto is necessary in order to ensure that construction <br />and use of the public way is carried out in compliance with current provisions of the Eugene Code, <br />1971. The Rule and Manual attached as Exhibit A may be reviewed at the office of Damon Joyner, <br />Traffic Technical Team Supervisor, Public Works Department,1820 Roosevelt Boulevard, Eugene, <br />Oregon 97401 during normal business hours (9:00 a.m. to 5:00 p.m., Monday through Friday, <br />exclusive of holidays). <br />All persons wishing to comment thereon or object thereto must submit their comments or <br />objections to Damon Joyner, Traffic Technical Team Supervisor, Public Works Department, 1820 <br />Roosevelt Boulevard, Eugene, Oregon 97401, in writing, within thirty (30) days of the date of the <br />first publication hereof, as indicated below. The City Manager will thereafter adopt Construction <br />Within and Use of the Public Way Administrative Rule R-7.302, as proposed, or as amended in <br />response to comments received. <br />Dates of Publication: <br />DENNIS M.
