ADMINISTRATIVE ORDER N0.58-03-21 of the City Manager of the City of Eugene CONCERNING NOTICE OF INTENDED AMENDMENT OF FEES FOR RIGHT-OF-WAY CUT PERMITS AND REPEAL OF ADMINISTRATIVE ORDER N0.58-02-29-F. The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and license permits. In accordance with the procedures set forth therein, and the further authority; ~ .Section 7.300 of the Eugene Code, 1971, Administrative Order No. 58-02-29-F was adopted on February 18, 2003, establishing the maj or aerial installation permit fees and reformatting and ratifying the unamendednght-of--way cut permit fees. B. The Annual "Blanket" Permit fees and Individual Permit fees set forth in Sections I and II of the Utility right-of--Way Use Permit Fees Schedule will sunset on December 31, 2003. The Utility Permit Program has an obj ective to recover the full costs associated with permitting and t, ` inspection. Fees necessary to achieve full cost recovery have been calculated by City staff. Based on this calculation, an increase in permit and project fees is necessary in order to recover the full costs of the utility permit program. The proposed permit fees as set forth in Exhibit A hereto, should become effective January 1, 2004. C. I have reviewed and concur with the staff s calculations and recommendations. The fees set forth in Exhibit A hereto are consistent with applicable policies and directives of the City Council, comparable to the fees established in other jurisdictions for providing such services, and are necessary in order to comply with the City Council's directive and the requirements of Section 7.300 of the Eugene Code, l 971, that all of the City's costs related to processing the applications for the permits and inspecting the work during and after completion of the work be fully recovered. On the basis of these findings, I order that: 1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two locations at City Hall, published in the Register-Guard, a newspaper of general circulation within the City, and be made available for inspection by interested persons at the office of Damon Joyner, Traffic Technical Team Supervisor, 1820 Roosevelt Boulevard, Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). 2.
