ADMINISTRATIVE ORDER NO. 58-04-03 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF <br />TREE REMOVAL AND STREET TREE PLANTING <br />PROGRAM FEE SCHEDULE; RATIFICATION OF <br />UNAMENDED FEES; AND REPEAL OF ADMINISTRATIVE <br />ORDER N0.58-00-02-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Pursuant to the provisions of Sections 2.020, 6.330 and 7.280 of the Eugene Code, <br />1971, on March 30, 2000, Administrative Order No. 58-00-02-F was issued establishing the Tree <br />Removal and Street Tree Planting Program Fee Schedule as set forth in Exhibit A thereto. <br />B. Because amendments to the City's Street Tree Program Administrative Rule R-7.280 <br />have occurred, portions of the text in the -fee schedule should be revised for clarification and <br />conformity with those amendments, the method that tree establishment fees are computed should be <br />revised to provide clear direction to both the City and Developers, and the other fees should be <br />ratified and affirmed: <br />C. I find that the revisions to the Tree Removal and Street Tree Planting Program Fee <br />Schedule as set forth in Exhibit A hereto are consistent with applicable policies and directives of the <br />City Council, are based on the City's costs associated with providing the services, and are necessary <br />in order to recover those costs from the beneficiaries of the services. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted at'two <br />locations at City Hall, be made available for interested persons at the Public Works Deparhnent, <br />1820 Roosevelt Blvd., Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m., <br />Monday through Friday, exclusive of holidays), and published in the Register Guard, a newspaper <br />of general circulation within the City. <br />2. All persons desiring to comment thereon shall submit written comments as set forth <br />in the Notice.
