ADMINISTRATIVE ORDER NO. ~~~ O~~ ~~ <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF PROPOSED ADOPTION OF INDEXING OF <br />EQUIVALENT ASSESSMENT RATES ADMINISTRATIVE RULE R-7.407. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules <br />and regulations necessary for the administration or enforcement of provisions of the Eugene Code, <br />1971. <br />B. Chapter 7 of the Eugene Code, 1971 ("EC") contains the general provisions <br />governing the initiation, construction, and assessment for local improvements, including provisions <br />that authorize the deferral or modification of assessment payments, and imposition of a delayed, or <br />equivalent assessment. Under EC 6.476(1) an owner who proposes to connect property to a City <br />wastewater sewer who has not previously paid a local improvement assessment for that wastewater <br />sewer, is required to pay an equivalent assessment prior to the connection being authorized. Similar <br />provisions for imposition of an equivalent assessment for street improvements are set forth in EC <br />7.407. <br />C. Those provisions provide that when a local improvement has been constructed by the <br />City and an equivalent assessment is to be imposed, the City Engineer shall, to the degree <br />practicable, establish the equivalent assessment rate based on the actual cost of the improvement <br />when it was constructed, plus an indexing factor to bring the historic costs up to date. <br />D. The City Engineer has recommended the adoption of a methodology and formula for <br />computation and indexing of equivalent assessments and their implementation. I have reviewed and <br />concur with the City Engineer's recommendation and find that adoption of the Indexing of <br />Equivalent Assessment Rates Administrative Rule R-7.407 as hereinafter set forth is necessary in <br />order to provide uniformity and clarity in the computation of equivalent assessments and their <br />implementation. <br />Based on the above findings, I hereby propose to adopt the following: <br />INDEXING OF EQUIVALENT ASSESSMENT RATES <br />ADMINISTRATIVE RULE R-7.407 <br />R 7.407-A Definitions. <br />As used in this Rule, the following words and phrases•are defined as follows: <br />Administrative Order -1 <br />
