<br />ADMINISTRATIVE ORDER NO. 58-99-06-F <br />of the <br />City Manager of the City of Eugene <br />ADOPTION OF FEES RELATED TO <br />STREET AND POLE BANNER PERMITS. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. <br />B. In accordance with the procedures set forth therein, on April 14, 1999 i issued <br />Administrative Order No. 58-99-06 proposing to establish the Street and Pole. Banner Fee <br />Schedule as set forth in Exhibit A attached thereto and incorporated by reference. <br />C. The Notice was provided to the Mayor and City Councilors, posted at two <br />locations at City Hall on April 16, 1999, provided to persons who had requested such <br />notice, and was made available for inspection by interested persons at the offices of the <br />City's Public Works Department, Transportation Division, 858 Pearl Street, Eugene, <br />Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br />Friday, exclusive of holidays). The Notice provided that written comments would be <br />received thereon for a period of fifteen days from the date of posting. No comments were <br />received within the time and manner required by the Notice. <br />D. I find that the proposed fees reflect the costs incurred by the City, including <br />salary, benefits, materials, supplies and indirect costs for employees performing the <br />services associated with scheduling. and .coordinating requests for banner mounting sites, <br />confirming and/or notifying applicants of the availability of specific mounting sites, <br />processing permits for work within the public rights-of--way as necessary, costs incurred <br />when the City is required to remove a banner, and are necessary in order to comply with <br />the Council's goal of recovering the cost of providing such services from the beneficiaries <br />thereof. <br />On the basis of these findings, 1 order that: <br />The fees set forth in the Street and Pole Banner Fee Schedule attached as Exhibit <br />A hereto are hereby established as the fees to be charged for the services set forth therein, <br />as of the effective date of this order. <br />Dated and effective this ~ day of May, 1999. <br />9'" <br />1~1~.~ <br />James R.
