ADMINISTRATIVE ORDER N0.58-99-15
of the
City Manager of the City of Eugene
CONCERNING NOTICE OF INTENDED FEES FOR ENGINEERING SERVICES
FOR PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS
AND REPEALING ADMINISTRATIVE ORDER NO.58-97-12-F
The City Manager of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to
determine and set fees and charges to be imposed by the City for services, goods, use of
municipal property, and licenses and permits. In accordance with the procedures set forth
therein, and the further authority of Section 7.130 of the Eugene Code, 1971, Administrative
Order No. 58-97-12-F was adopted on July 14, 1997 establishing fees for engineering services
for privately constructed public improvements.
B. These engineering services are provided on request to private parties and other
governmental agencies that construct projects that become public improvements upon
completion and are charged for on an hourly basis. Hourly rates are established at the start of
each fiscal year to recover the full cost of engineering services for each classification of
engineering employee. I therefore intend to repeal the currently effective fees set forth in
Administrative Order No. 58-97-12-F and establish fees based on the hourly rates of engineering
employees for the 1999-2000 fiscal year as set forth in the Notice of Intended Fees attached as
Exhibit A hereto and incorporated herein by reference.
C. The fees set forth in Exhibit A hereto are consistent with applicable policies and
directives of the City Council, comparable to the fees established in other jurisdictions and
private businesses for providing such services, are based on the hourly rates of engineering
employees, and are necessary in order to comply with the City Council's directive and the
requirements of Section 7.130 of the Eugene Code, 1971 that the fee charged for these services
recover the City's full costs, including plan review, engineering, inspection and overhead costs..
On the basis of these findings, I order that:
1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two
locations at City Hall, and be made available for interested persons at the offices of the City
Manager, 777 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to
5:00 p.m. Monday through Friday, exclusive of holidays).
2. All persons desiring to comment thereon shall submit written comments as set
forth in the Notice. I will thereafter establish the fees by an administrative order.
'~ Dated this day of July, 1999.
t_._ ~
James R. ohnson, City Manager
