ADMINISTRATIVE ORDER N0.58-99-15-F <br />of the <br />City Manager of the City of Eugene <br />ESTABLISHING FEES FOR ENGINEERING SERVICES <br />FOR PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS <br />AND REPEALING ADMINISTRATIVE ORDER NO. 58-97-12-F <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, and <br />licenses and permits. <br />B. In accordance with the procedures set forth therein, and the further authority of <br />Section 7.130 ofthe Eugene Code, 1971, on July 9, 1999 I notified the Mayor and City Council that <br />I intended to repeal the currently effective fees for engineering services for privately constructed <br />public improvements as established by Administrative Order No. 58-97-12-F on July 14, 1997. The <br />Notice was also posted at two locations at City Hall on July 9, 1999, and. made available for <br />inspection by interested persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon <br />97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of <br />holidays). The Notice provided that written comments would be received thereon for a period of 15 <br />days from the date of posting. No comments were received within the time or in the manner required <br />by the Notice. <br />C. I find that the fees set forth in Exhibit A hereto are .consistent with applicable policies <br />and directives of the City Council, comparable to the fees established in other jurisdictions and private <br />businesses for providing such services, are based on the hourly rates of engineering employees, and <br />are necessary in order to comply with the City Council's directive and the requirements of Section <br />7.130 ofthe Eugene Code, 1971 that the fees charged for these services recover the City's full costs, <br />including plan review, engineering, inspection and overhead costs.. <br />On the basis of these findings, I order that: <br />1. The fees set forth in Exhibit A hereto are hereby established as the fees to be charged <br />for the~services set forth therein, effective 12:01 a.m., August 1,-1999. <br />2. Administrative Order No. 58-97-12-F, and the fees established therein are repealed <br />as of midnight, July 31, 1999. <br />Dated this S day of August, 1999. <br />James R.
