<br />BEFORE THE CITY COUNCIL OF <br />THE CITY OF EUGENE <br />In re Review of the ) <br />Administrative Order ) <br />of the City Manager ) ORDER <br />adopting Rules ) <br />Governing the Use of ) <br />Mahlon Sweet Airport ) <br />The City Council of the City of Eugene finds as follows: <br />1. The City Manager is required to adopt rules <br />governing the use of Mahlon Sweet Airport under Eugene Code, <br />1971, Section 2.430(1). These rules are to be adopted or <br />revised under the procedures set out in sections 2.430 and <br />3.012 of the code. <br />2. The current rules were adopted in February, 1969 <br />and no longer serve the needs of a larger airport facility. <br />3. The City Manager has adopted new rules governing <br />the use of Mahlon Sweet Airport. These rules have been <br />reviewed by the City Attorney's Office, the Department of <br />Public Safety and other affected city departments. They have <br />been approved by the Airport Commission. The Airport Manager <br />has met with different users of the Airport and obtained <br />additional comment on the rules. Comments and suggestions <br />have been received from the local and regional offices of the <br />Federal Aviation Administration. <br />4. Notice of intended rulemaking was published in the <br />Register-Guard on June 4 and June 11, 1989. Copies of the <br />proposed rules have been sent to all current operators at the <br />Airport and to persons who have commented upon or requested <br />copies of the rules. The rulemaking procedures comply with <br />section 3.012 of the Eugene Code, 1971. <br />5. The Council has reviewed the adopted rules pursuant <br />to Section 2.430 of the Eugene Code, 1971. <br />NOW, THEREFORE, the City Council of the City of Eugene <br />Orders that: <br />1. The "Rules Governing Use of Mahlon Sweet Airport" <br />approved by the City Manager on July 26, 1989, are approved. <br />These rules are effective as of the date of this order. <br />2.
