ADMINISTRATIVE ORDER NO. 5&92-03 <br />.., _ of the <br />City Manager of the City of Eugene <br />Revising Methodologies: <br />City of Eugene Systems Development Charges <br />The .City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.710 of the Eugene Code, 1971 authorize the City <br />Manager to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, licenses and permits, including those set forth in the <br />Methodologies: City of Eugene Systems Development Charges, adopted by the Council <br />on May 8, 1991. <br />B. In accordance with the procedures set forth therein, on December 13, 1991 <br />I notified the Mayor and City Council that I intended to revise the rate-setting <br />methodologies for transportation systems development charges to include additional caps <br />for p.m. peak hour trip rates, as set forth in the Notice of Intended Methodologies: City <br />of Eugene Systems Development Charges attached as Exhibit A thereto. The Notice was <br />also posted at two locations at City Hall on December 17, 1991, and made available to <br />interested persons at the office of the City Manager. The Notice provided that written <br />~" comments would be received thereon for a period of 15 days from the first date of posting. <br />No written comments were received within the time provided in the Notice. <br />C. I find that the rate-setting methodologies hereinafter set forth would result <br />in transportation system development charges that are consistent with applicable policies <br />and directives of the City Council; are consistent with the system development charge <br />methodology adopted by the City Council; and will impose an equitable share of the public <br />cost of capital improvements upon developments that are capped. <br />On the basis of these findings I order that: <br />1. Paragraph 3 under Section 3.2 of the Methodologies: City of Eugene Systems <br />Development Charges, adopted by the Council on May 8, 1991 is amended to provide: <br />The trip rates contained in this Manual have been adjusted by staff to reflect <br />pass-by trips. This is accomplished by setting caps of ten trips per Thousand Gross <br />Square Feet and 5.10 trips per Pump for respective developments. This adjustment <br />would generally encompass developments which might be considered pass-by in <br />nature. <br />2.
