~-: _..._ <br />~. <br />ADMINISTRATIVE ORDER NO. .~$ - Z - D <br />of the <br />~ CITY MANAGER OF THE CITY OF EUGENE, OREGON <br />Extending the Effective Date of <br />Emergency Rule R-5.040 -Establishing Residential <br />Permit Parking Zone Regulations <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the authority of Section 5.040 of the Eugene Code, 1971, which <br />authorizes the City Manager to establish parking zones or restrict parking upon the streets <br />of the City, and Section 2.019 of the Eugene Code, 1971, on August 15, 1991 I adopted <br />Emergency Rule R-5.040 -Establishing Residential Permit Parking Zone Regulations. <br />B. Prior to its expiration on February 15, 1992, Emergency Rule R-5.040 was <br />extended for an additional 30-day period by Administrative Order No. 5&92-OS to allow <br />an opportunity to adopt the rule as a permanent rule. Publication of the notice of intent <br />to adopt Emergency Rule R-5.040 as a permanent rule was defective, and the effective <br />date of Emergency Rule R-5.040 should therefore be extended for an additional 30 days. <br />,- C. Section R-5.040-C of Emergency Rule R-5.040 should also be amended to <br />provide an additional process for establishment of residential permit parking zones by the <br />Traffic Engineer as hereinafter more particularly set forth, and a new Section R-5.040-Q <br />added thereto to authorize a reduction or waiver of fees and the criteria therefor. <br />D. The program being administered pursuant to Emergency Rule R-5.040 affects <br />the public welfare and safety, and the public interest will be prejudiced if the effective date <br />is not extended and amended as provided herein. <br />Now, therefore, based upon the above findings, <br />1. Residential Permit Parking Zone Regulations Emergency Rule R-5.040-C is <br />hereby amended to provide: <br />R-5.040-C INITIATION. <br />1. Application by owner/resident. A request to establish a residential <br />permit parking zone shall be submitted to the City on a form provided by or <br />approved by the City. The application shall be accompanied by a fee established <br />by the City Manager pursuant to .Section 2.020 of the Eugene Code, 1971, and shall <br />be signed by more than 50% of the owners and residents within the block or blocks <br />Administrative Order <br />
