ADIVIINISTRATIVE ORDER NO. 5R-93-9 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED FEES FOR ENGINEERING SERVICES <br />FOR PRIVATELY CONSTRUCTED PUBLIC IQVIPROVEMENTS <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. In accordance with the procedures set forth <br />therein, and the further authority of Section 7.130 of the Eugene Code, 1971, on August 14, <br />1992 I adopted Administrative Order No. 58-92-15 establishing fees for engineering services <br />for privately constructed public improvements. <br />B. These engineering services are provided on request to private parties -and <br />other governmental agencies that construct projects that become public improvements upon <br />completion and are charged for on an hourly basis. Hourly rates are established at the start <br />of each fiscal year to recover the full cost of engineering services for each classification of <br />engineering employee. I therefore intend to repeal the currently effective fees set forth in <br />Administrative Order No. 58-92-15 and establish fees based on the hourly rates of <br />engineering employees for the 1993-94 fiscal year as set forth in the Notice of Intended Fees <br />attached as Exhibit A hereto and incorporated herein by reference. <br />C. The fees set forth in Exhibit A hereto are consistent with applicable policies <br />and directives of the City Council, comparable to the fees established in other jurisdictions <br />for providing such services, are based on the hourly rates of engineering employees, and are <br />necessary in order to comply with the City Council's directive and the requirements of <br />Section 7.130 of the Eugene Code, 1971 that the fee charged for these services recover the <br />City's full costs, including plan review, engineering, inspection and overhead costs. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted <br />at two locations at City Hall, and be made available for interested persons at the offices of <br />the City Manager, 777 Pearl Street, Eugene, Oregon 97401, during normal business hours <br />(8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />2. All persons desiring to comment thereon shall submit written comments as set <br />forth in the Notice.
