ADMINISTRATIVE ORDER NO. 58-93- ~ 0 <br />of the <br />: j City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED MWMC EQUALIZATION FEES <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. In accordance with the procedures set forth <br />therein, and the further authority of Section 7.710 of the Eugene Code, 1971, on June 29, <br />1992 I adopted Administrative Order No. 58-92-13 establishing Metro Wastewater <br />Management Commission (MWMC) Facilities Equalization Fees and Credits for the fiscal <br />year commencing July 1, 1992. <br />B. The MWMC Equalization Fee is a systems development charge paid by <br />property owners and developers for new construction that is connecting to the sanitary sewer <br />for the first time, and for the expansion of existing commercial and industrial development <br />that increases demand on the sanitary sewer system. The fee is administered and collected <br />by the City for property within the City's service area. <br />C. There are two classifications to the Equalization Fee. The Residential Fee is <br />applicable to single family residences and residential uses of up to two dwelling units, with <br />the fee being based on the number of dwelling units in the development. All other uses are <br />classified as Commercial/Industrial, with the fee being calculated on the number of plumbing <br />fixture units in the development. The fee for existing Commercial/Industrial property <br />connecting to the sanitary sewer system for the first time is based on the amount of water <br />used by the existing development. <br />D. A one-time credit is available for newly connecting property within the City <br />and for property outside the City. The amount of credit for newly connecting property <br />within the City is based on the date of annexation to the City, the date of construction of <br />any improvements since 1978, and the current value of the land and improvements. For <br />development outside the City, the credit is based on the date of assessment for the sewer, <br />the date of construction of any improvements, and the current value of land and <br />improvements. <br />E. MWMC has requested a revision in the IIZWMC Facilities Equalization Fee <br />and Credits for the fiscal year beginning July 1, 1993, and I find the proposed fees are <br />established in an amount designed to equal the amount existing system users have paid for <br />reserve capacity since 1978, are in conformity with adopted City policies and guidelines, <br />including Sections 2.020 and 7.710 of the Eugene Code, 1971, and I therefore intend to <br />repeal the currently effective fees and credits set forth in Administrative Order No. 58-92-13 <br />and establish MWMC Facilities Equalization Fees and Credits for the 1993-94 fiscal year as <br />set forth in the Notice of Intended Fees attached as Exhibit A hereto and incorporated <br />Administrative Order - 1 <br />
