`_ ~~~ <br />ADMINISTRATIVE ORDER NO. 58-93-20-F <br />of the <br />City Manager of the City of Eugene <br />ESTABLISHING TREE PRESERVATION FEES <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Sections 2.020 and 6.300 to 6.330 of the Eugene Code, 1971 authorize the City <br />Manager to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, licenses and permits, and specifically the City's tree <br />preservation permit process. <br />B. In accordance with the procedures set forth therein, on October 15, 1993 I <br />notified the Mayor and City Councilors that I intended to establish fees for processing tree <br />felling applications, and for appeals therefrom, as set forth in the Notice of Intended Fees <br />attached as Exhibit A thereto and incorporated therein by reference. The Notice was also <br />posted at two locations at City Hall on October 15, 1993, published in the Register Guard <br />on October 17, 1993, and made available for inspection by interested persons at the office <br />of the City Manager. The Notice provided that written comments would be received <br />thereon for a period of 15 days from the first date of posting and publication. No written <br />comments were received within the time or in the manner provided in the Notice. <br />C. I find that the fees hereinafter set forth are consistent with applicable policies <br />and directives of the City Council, including policies developed through the Eugene <br />Decisions process, are based on the City's estimation of the costs associated with performing <br />the services, and are necessary in order to recover those costs from the beneficiaries of the <br />services. <br />On the basis of these findings, I order that the following fees for Tree Preservation <br />Services are hereby established: <br />Tree Preservation Services <br />Schedule of Fees <br />Permit application fee: <br />1 - 10 trees to be felled, no public notice <br />or comment period required <br />1 - 10 trees to be felled, public notice <br />and comment period required <br />11 - 50 trees to be felled <br />51 + trees to be felled <br />$ 50.00 <br />$125.00 <br />$275.00 <br />$475.00 <br />Appeal fee $700.00 <br />Administrative Order - 1 <br />
