ADMINISTRATIVE ORDER NO. ,S"g- 94~- 09 <br />of the <br />City Manager of the City of Eugene <br />Proposed Traffic Diverter Procedure <br />Administrative Rule R-5.040TD <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Section 5.040 of the Eugene Code, 1971, the City <br />Manager has authority to establish, maintain, remove or alter traffic control areas and traffic <br />control devices, including traffic diverters. Ordinance No. 19779, which amended Section <br />5.040 of the Eugene Code, 1971, repealed the Traffic Diverter Policy set forth in Resolution <br />No. 2414 and requested that the City Manager establish similar procedures administratively. <br />Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules <br />necessary for the administration or enforcement of provisions of the Eugene Code, 1971. <br />B. The installation of traffic diverters is recognized as a means of improving the <br />living environment along local streets that are affected by adverse traffic conditions that <br />typically include average daily traffic volumes in excess of 500 vehicles,. more than 35% <br />through traffic (i.e., traffic passing through the area), and greater than 10% through truck <br />traffic and 85th percentile speeds over 30 miles per hour. It is also recognized that the <br />installation of such devices may have detrimental impacts on other nearby local streets and <br />deleterious effects on nearby arterial streets and intersections. <br />C. Establishment of procedures to be followed for initiating, processing, installing <br />or removing traffic diverters is necessary in order to ensure adequate citizen involvement in <br />the process and evaluation by City staff prior to and after installation. <br />Now, therefore, based upon the above findings, <br />I hereby purpose to adopt the following Traffic Diverter Procedure Administrative <br />Rule R-5.040TD: <br />~ ~ C DIVERTER PROCEDURE <br />ADMINISTRATIVE RULE R-5.040TD <br />R-5.040TD-A DEFINITIONS. <br />In addition to applicable definitions set forth in the Eugene Code, 1971, as used <br />herein, the following mean: <br />Local street.
