ADl\11NISTRATIVE ORDER 1Y0. 58-94-I.0 <br />of the <br />City ~'t~nager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED M'~VMC EQUALIZATION FEES <br />AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-93-11 <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code; 1.971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />anti licenses and permits. In accordance with the procedures set forth therein, and the further <br />authority of Section 7.710 of the Eugene Code, 1.971, on June 30, 1993 I adopted Administrative <br />Order No. 58-93-11 establishing Metro Wastewater Management Commission (MWMC) Facilities <br />Equalization Fees and Credits for the fiscal year commencing July 1, 1993. <br />B. The MWMC Equalization Fee is a systems development charge paid by property <br />owners and developers for new construction that- is connecting to the sanitary sewer for the first <br />time, and for the expansion of existing commercial and industrial development that increases <br />demand on the sanitary_ sewer system. The fee is administered and collected on behalf of the <br />MWMC by the Cih~ for property within the City's service area. <br />C. There are two classifications to the Equalization Fee. The Residential Fee is <br />`' applicable to single family residences and residential uses of up to two dwelling units, with. the <br />fee being based on the number of dwelling units in the development. Ail other uses are classified <br />as Commercial/Industrial, with the fee being calculated on the number of plumbing fixture units <br />in the development. The fee for existing Commercial/Industrial property connecting to the <br />sanitary sewer system for the first: time is based on the- amount of water used by the existing <br />development. <br />D. A one-time credit is available for newly connecting property within the City. The <br />amount of credit for newly connecting property within the City is based on the date of annexation <br />to the City, the date of construction of any improvements since 1978, and the current value of <br />the land and improvements. <br />E. M\~~MC has requested that the City implement the annual revision in the MWMC <br />Facilities Equalization Fee to reflect the increase in the facility's equity paid by existing users, <br />and to the Credits for the fiscal year beginning July 1, 1.994 because of the increase in property <br />taxes paid to decrease the debt service on the facility. I find the proposed fees are established <br />in an amount designed to equal the amount existing system users have paid for reserve capacity <br />since 1978, are in conformity- with adopted City policies aild guidelines, including Sections 2.020 <br />and 7.710 of the Eugene Code, 1971, and I therefore intend to repeal the currently effective fees <br />and credits set forth in Administrative Order No. 58-93-1.1 and establish MWMC Facilities <br />Equalization Fees and Credits be<~innin~T in the 1994-95 fiscal year as set forth in the Notice of <br />~.
