s <br />,~ <br />ADMINISTRATIVE ORDER NO. ~8-94-11 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF PROPOSED LNCREASE LN <br />VVASTE~+I~ATE:R USER FEES AND REPEAL OF ADA7:INISTRATIVE <br />ORDERS NO. 58-93-OG AND NO. ~8-94-08 <br />The City M.an~ger of the City of Eugene finds as follows: <br />A. Section 6.411. (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the <br />City Manager to determine and set fees acid charges to be imposed by the City for wastewater <br />service and for regional wastewater service. In accordance with the procedures set forth therein, <br />on May 15, 1993 I adopted Administrative Order No. 58-93-06 establishing sewer user rates for <br />the fiscal year commencing Ju}y 1, 1993 and ending Jw1e 30, 1994. <br />I3. Notice of the proposed wastewater service charges to begin on July 1, 1994 was <br />originaly provided by Administrative Order 58-94-08, dated May 1.7, 1994. Due to an error in <br />publication of the Notice by the Register Guard, it is necessary to provide new Notice of the <br />proposed wastewater charges and. to reschedule the public hearing on those proposed charges. <br />C. Pursuant to Subsection 6.41.1{1) of the Eugene Code, 1971, 1 have conducted an <br />'' investigation of the revenue needs of the City in providing these services and reviewed the <br />recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br />D. Based on that investigation and recommendation, Iintend to increase the user fees <br />for wastewater service and regional wastewater treatment service as set forth in the Notice of <br />Lntended Fees attached as L-xhibif~ A aiereto and incorporated herein by reference, and repeal the <br />currently effective fees established ly Administrative Order No. 58-93-06. I find the proposed <br />fees are in compliance With, the .Council's directive that the costs of providing such services be <br />recovered from the beneficiaries of the services, and other applicable policies and directives of <br />the Council; are consistent with applicable federal and state regulations and the recommendations <br />of Ni\?VM.C; are comparable to the amowlts charged by the City of Springfield and other suc11 <br />service providers; will preserve equity between different classes of ratepayers; and are based on <br />the proposed budget of the City of Eugene and the adopted budget of MWM.C. <br />On the basis of these findings, 1 order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, the news <br />media, an_y person ~~-1~o h:is requested notice, to interested governmental agencies (including the <br />United States Enviro+imei~tal Protection Agency,. the Department of Environmental Quality, <br />M~A~MC, and the Eugene 1~!ater & Electric Board), posted at two locations at City Hall, published <br />on two separate occasions in tine Register Guard, a newspaper of genera.! circulation Witilln the <br />City, and be made available for interested persons at the offices of the Public Works Department, <br />858 Pear!
