< _; <br />ADMINISTRATIVE ORDER NO. 58-94- ({'{ <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED INCREASE IN MAINTENANCE SERVICE RATES <br />FOR SIDEWALK REPLACEMENT AND GRINDING <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. in accordance with the procedures set forth <br />therein, and the further authority of Section 7.130 of the Eugene Code, 1971, on or about <br />December 10, 1986, I adopted rates for maintenance services for sidewalk replacement <br />and grinding. <br />13. These maintenance services are provided on request to private parties and <br />other governmental agencies that construct projects that become public improvements <br />.upon completion and are charged for on a per square foot hourly basis for replacement, <br />and a -flat rate for grinding. The rates are established to recover. the full cost of mainten- <br />ance services for each project. The City's personnel and other costs necessary for <br />administration of this program have increased since 1986 and. I therefore intend to <br />increase the currently effective rates as set forth in the Notice. of intended Fees attached <br />as Exhibit A hereto and incorporated herein by reference. <br />C. The proposed rates set forth in Exhibit A hereto are consistent with <br />applicable policies and directives of the City Council, comparable to the rates established <br />in other jurisdictions for providing such services, and are necessary in order to comply with <br />the City Council's directive and the requirements of Section 7.130 of the Eugene Code, <br />1971 that the rate charged for these services recover the City's full costs of administering <br />the program. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor aTid City Councilors, <br />published in the Register-Guard, a newspaper of general circulation within the city, posted <br />at two locations at City Hali, and be made available for interested persons at the offices of <br />the City Manager, 777 Pearl Street Room 105, Eugene OR 97401, during normal business <br />hours 18:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />_~ <br />2. _ All persons desiring to comment thereon shall submit written comments as <br />set forth in the Notice. twill thereafter establish the fees by an administrative order. <br />Dated this ~~ day of ~~1~ 1994. ~ <br />~~ / <br />Michea ea can, ,City Man ger <br />Administrative Order <br />
