.~ <br />ADMINISTRATIVE ORDER NO. 58-95-03-F <br />of the <br />City Manager of the City of Eugene <br />ESTABLISHING INDUSTRIAL PRETREATMENT <br />PROGRAM FEES <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 6.54b of the Eugene, Code, 1971 authorize the City Manager of <br />the City of Eugene to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits, and specifically charges and fees to be <br />paid by the industrial users of the City wastewater system who are subject to the provisions of <br />Sections 6.501 to 6.596 of the Eugene Code, 1971. <br />B. In accordance with the procedures set forth therein, on Apri127, 1995 I notified the <br />Mayor and City Council that I intended to establish fees for: (a) annual industrial discharge permit; <br />(b) filing an appeal of an administrative penalty; and (c) recovery of time and resource costs <br />associated with resampling violations, as set forth in the Notice of Intended Fees attached as Exhibit <br />A thereto and incorporated therein by reference. The Notice was also posted at two locations at City <br />Hall on April 28,.1995, published in the Register Guard, a newspaper of general circulation within <br />the City on Apri130, 1995,.and made available for inspection by interested persons at the offices of <br />the City Manager, 777 Pearl Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. <br />to 5:00 p.m., Monday through Friday, exclusive of holidays). The Notice provided that written <br />comments would be received thereon for a period of 15 days from the first date of posting and <br />publication. No comments were received within the time or in the manner required by the Notice. <br />C. I find that the fees set forth in Exhibit A hereto are consistent with applicable policies <br />and directives of the City Council, including those developed during the Eugene Decisions process,. <br />and the provisions of Section 6.546 of the Eugene Code, 1971, that requires fees be established that <br />reduce the City's costs associated with setting up and operating the pretreatment program; <br />establishing sampling, monitoring, inspection, and surveillance procedures; reviewing accidental <br />discharge procedures and controls; and processing permit applications, and should become effective <br />June 1, 1995. <br />On the basis of these findings, I order that: <br />a- <br />The fees set forth on Exhibit A attached hereto and incorporated herein by reference are <br />hereby established as the fees to be charged for the services set forth therein, commencing June 1, <br />1995. <br />Dated this ~~ day of May, 199 <br />~~ <br />
