• .i ADMINISTRATIVE ORDER NO. 58-95-OS of the City Manager of the City of Eugene CONCERNING NOTICE OF PROPOSED INCREASE IN WASTEWATER USER FEES AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-94-].l-F The City Manager of the City of .Eugene finds as follows: A. Section 6.41. ]. (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the City Manager to determine and set fees and charges to be imposed by the City for wastewater service and for regional wastewater service. In accordance with the procedures set forth therein, on June 23, 1994, I adopted Administrative Order No. 58-94-11-F establishing sewer user rates for. the fiscal }year commencing July 1, 1994. Ii. Pursuant to Subsection 6.4 t 1(1) of the Eugene Code, 1971., I have conducted an investigation of the revenue needs of the City iii providing these services and reviewed the recanmendation of the Metropolitan Wastewater Management Commission (MWMC). C. The MWMC has revised the method used to allocate costs among customer classes, and has also reallocated costs between the flat monthly component of the MWMC fee and the flow based component of that fee. The customer service charges recommended by MWMC reflect this revised cost allocation. D. Based on that investigation and recommendation, Iintend to revise the user fees for wastewater service and regional wastewater treatment service as set forth in the Notice of Intended Fees attached as .Exhibit A hereto and incorporated herein by reference, and repeal the currently effective fees established by Administrative Order No. 58-94-11-F. I find the proposed fees are in compliance with the Cow~cil's directive that the costs of providing, such services be '` recovered from the beneficiaries of the services, and other applicable policies and directives of ~' the Council; are consistent with applicable-federal and state regulations and the recommendations of MWMC; are comparable to the amounts charged by the City of Springfield and other such service providers; will preserve equity between different classes of ratepayers; and are based on the proposed budget of the City of Eugene and the adopted budget of MWMC. ,;' On the basis of these findings, [order that: l..
