ADMINISTRATIVE ORDER I\'O. 58-95-06 <br />of the <br />City 17anager cif the City of Eugene <br />CONCERNLNG NOTICE OF PROPOSED AR!fENDMENT OF MWMC <br />EQUAi 17AT.ION FEES AN.D REPEAL OF <br />AD~!tINISTRATIV.E ORDER NO. 58-94-10-F <br />The City Manager of the City of Eugene finds ns follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed b}~ the City for services, goods, use of municipal property, <br />and licenses and permits. In accordance ~~~ith the procedures set forth therein, and the further <br />authority of Section 7.7 i 0 of the Eugene Code, 1971, on .lone 24, ! 994 I adopted Administrative <br />Order No. 58-94-10-F establishing )\~fetro ~~~aste~water Management COn1misSlOn (MWMC) <br />Facilities Equalization Fees and Credits for the fiscal year commencing July I, 1.994. <br />[i. The M.1~~MC Equalization Fee is a systems development charge paid by property <br />owners and developers for new construction that is connecting to the sanitary sewer for the first <br />time, and for the expansion of existing commercial a»d industrial development that increases <br />demand on the sanitar}~ sewer system. The fee is administered and collected by the City for <br />property within the City's service area. <br />C. There are -two classifications to the Equalization Fee. The Residential Fee is <br />applicable to single family residences and residential uses of up to ttiwo dwelling units, with the <br />fee being based on the number of dv,~elling emits in the development. All other uses are classified <br />as Commercial/Industrial, ~.vith the fee being calculated on the number of plumbing fixture units <br />in the development. The fee for existing Commercial/Industrial property colinecfing:ao the <br />sanitary sewer system for: the first time is based on the amount of water used by the existing <br />development. <br />D. A one-time credit for prior prol.~erty tax payments on 1\9VVSD bonded debt is <br />available for newly connecting property. The amount of credit for newly connecting. property <br />within the City is based on the date of annexation to the City, the date of construction of any <br />improvements since 1975, a.nd the current value of the land and improvements.. Credit is not <br />available for development outside_xfie City, as such property will not have paid MWSD taxes or <br />in-lieu-of-taxes prior to connection to the system. <br />E. M~TJMC has requested a revision in the MWMC Facilities Equalization Fee and <br />Credits beginning July 1, 1995, and I find the proposed fees are estab]ished in an amount <br />designed to equal the amount existing system users have paid for reserve capacity since 1.975, <br />are in conformity with adopted City policies and guidelines, including Sections 2..020 and 7.710 <br />of the Eugene Code, 1971, and I therefore intend to repeal the currently effective fees and credits <br />set forth in Adminisr,-ativ~ (;)rder ~o. 55-94-l0-F and establish Ni~~~i\-1C Facilities Equalization <br />Fees a.nd Credits col»mencin~~ with the 1995-96 fiscal }'ear as set forth in the Notice of Intended <br />Fees attached as Exhibit A hereto and incorporated herein by reference. <br />Administrative Ordcr - I <br />
