~, .:. <br />ADMINISTRATIVE ORllER NO.58-95-12-F <br />of the <br />AIRPORT MANAGER <br />INCREASING AI~tPORT TIE-DOWN FEES AND ESTABLISHING <br />AN AIRPORT FEE SCHEDULE <br />The Airport Manager of tl~e City of Eugene finds as follows: <br />A. Sections 2.440 to 2.442 of the Eugene Code, 1971, authorize the City Manager or designee to <br />set fees and charges for the use of the Eugene Airport. Under Airport Rule 8.4.2., the City Manager has delegated <br />that authority to the Airport Manager. <br />B. TIi accordance ~~~ith the procedtu-es set forth in Sections 2.440 to 2.442 of the Eugene Code, 1971, <br />on August I5, 1995, I issued AcLninistrative Order No. 58-95-12 proposing to increase the airport tie-down fees, <br />which were previously established on August 1, 1980, as set forth in the Notice of Intended Fees attached as <br />Exhibit A thereto. The Notice was provided to the Mayor and City Councilors, posted at two locations at the <br />Airport on August 18, 1995. published ui the Register Guard, a newspaper of general circulation within the City, <br />on August 20, 1995, and made available for inspection by interested persons at the offices of the Airport <br />Manager, 28855 Lockheed Drive, Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m., <br />Monday tlu-ough Friday, exclusive of holidays). The Notice provided that written continents would be received <br />thereon for a period of IS days Gom the first date of posting and publication. No responses were received within <br />the time or in the manner required by the Notice. <br />C. After investigatuig the fees charged at other airports, the Cily's policies on recovery of user fees, <br />and the revenue needs of the Eugene Airport, I have determined that the current tie-down fees at the Eugene <br />Airport, which hwe been in effect since August 1, 1980, should be increased as set forth in the Airport Fee <br />Schedule attached as Exhibit A hereto and incorporated herein by reference. <br />D. In addition to the airport tie-do~~a~ fees, other fees for services at the Airport have from time to <br />tune been established by administrative orders. I further fnd that it would be more efficient to rescind those prior <br />orders and combine the fees in the Airport Fee Schedule attached as Exhibit A hereto. <br />On the basis of these findings, I order that: <br />1. Administrative Order j~io. 58-91-01, and any other order in conflict with the fees established <br />and/or ratified herein are rescinded, as of the effective date of this Order. <br />2. The fees set forth in paragraph 1 of the Airport Fee Schedule attached as Exhibit A hereto are <br />hereby established as the Airport Tie-Down Fees, and the fees set forth in paragraphs 2 t1u-ough I1 are hereby <br />ratified and aff rn~ed as the fees to be charged for the sen ices set forth, as of the effective date of this order. <br />3. Copies of this Order shall be provided to the Mayor aild City Cow~cilors and to any persons wfio <br />have requested notice. Unless reviewed by the Co~u~cil (at the request of two Councilors), this Order, and the fees <br />established and/or ratified herein shall become effective on the 1 lth day after the date of issuance.' <br />A <br />
