washwater to enter the city stormwater system. <br />7. Discharges in violation of a general or individual NPDES <br />Stormwater or Wastewater Discharge permit. <br />8. Discharges that violate the state building code, .other state laws, <br />federal law, the Eugene Code, 1971, or adopted City policies. <br />9. Discharges in violation of the City of Eugene NPDES <br />Stormwater Discharge permit. <br />In the event that a release involves illegal/improper discharge to the city stormwater, <br />.system at more than one point, .each individual point of illegal/improper discharge <br />maybe .considered as a separate violation regardless of whether the release is a result <br />of a singular incident. <br />Industrial waste. Waste generated from a source or activity other than related <br />to a single or multiple dwelling unit. "Industrial waste" includes waste generated by <br />commercial use of a residential unit. <br />Major effort. The responsible person has taken all feasible steps to contain, <br />mitigate, and clean-up any discharged substance. There must have been active, <br />physical effort. which results in significant improvement of the situation. Verbal <br />communication is not sufficient by itself, but may be considered as part of the <br />necessary effort. <br />'Minor effort. The responsible person has taken few steps to contain, mitigate, <br />or clean-up any discharged substance. Due to the lack of active, physical effort, no <br />significant improvement in the situation is made and/or a significant opportunity to <br />further contain .the discharge or mitigate the situation was missed. Verbal <br />communication is not sufficient by itself; but may be considered as a part of the <br />necessary effort. <br />NPDES permit. National Pollution Discharge Elimination System permit <br />issued pursuant to ORS 468.740 and the Clean Water Act. <br />Person/PartX. (As in Person Responsible/Responsible Person/Responsible <br />Party.) Any individual, partnership, joint venture, firm, company, cooperative, <br />corporation, association, joint stock company, trust, estate, governmental entity or any <br />other legal entity. The masculine shall include the feminine and the singular shall <br />include the plural. <br />Prior enforcement action. Prior citations, civil penalties, or abatement charges <br />issued by the City against a responsible party for the same type of violation {i.e., <br />stormwater pollution related). <br />Prior violation.
