~~ <br />ADMINISTRATIVE ORDER N0.58-96-10-F <br />_ of the <br />City Manager Pro Tem of the City of Eugene <br />ESTABLISHING WASTEWATER USER FEES <br />AND REPEALING ADMINISTRATIVE ORDER N0.58-95-05-F <br />The City Manager Pro Tem of the City of Eugene finds as follows: <br />A. Section 6.411 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be. imposed by the City for wastewater service and for regional <br />wastewater service. <br />B. In accordance with the procedures set forth therein, on May 6, 1996 I issued <br />Administrative Order No. 58-96-10 proposing an increase in wastewater user fees as set forth in the <br />Notice attached thereto; and the repeal of Administrative Order No. 58-95-OS-F. <br />C. Copies of the Notice were provided to the Mayor and City Councilors, the news <br />media, any person who had requested notice, to interested governmental agencies (including the <br />United States Environmental Protection Agency, the Department of Environmental Quality, <br />MWMC, and the Eugene Water & ElectricBoard), and posted at two locations at City Hall. on May <br />6, 1995. The Notice was also published on May 6 and May 11,.1996 in the Register Guard, a <br />,newspaper of general circulation within the City, and made available for interested persons at the <br />offices, of the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal <br />business hours (8:00 a.m. to 5:00 p.m:, Monday through Friday, exclusive of holidays). <br />D. The Notice provided that written comments thereon could be submitted for a period <br />of 1D days from the first date of publication and posting, or at a public hearing to be held on May <br />17, 1995. One written comment was received within the time or in the manner required by the <br />notice,. - No testimony was submitted at the public hearing. <br />Comment: Mr. G. S. Anson suggested that revisions be made to the residential and <br />commercial base rates, aid that the "Medium Strength" commercial customer class <br />be rede .fined based on'amount of flow rather than pollutant loading. <br />Finding: No information was provided by the cornmentor on the reasons for the <br />sugestion. Redefining the Medium Strength customer class on the' basis of flow <br />would not allow recovery of the costs associated with higher pollutant loadings for <br />that class of customers, so no changes in response to this comment have been made. <br />In addition, staff has contacted the individual to provide more information on the rate <br />model and cost allocation model. <br />E: Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br />Administrative Order - 1 <br />
